Stolen Credit Card Question

Not sure if this is the right place to enter this?
I have just heard from John Lewis that our credit card that was being sent to us in the post has been used fraudlently.
Turns out they used the card in Apple to buy £1948 worth if goods and used the PIN to do so!!!
Clearly the card has been stolen on route but am I now going to be liable for the transaction as they used the pin? i have no idea how they got it but have heard horror stories about banks not refunding this transactions as they claim you were negligent.
I have no idea how the card was stolen or activated let alone how the PIN was found.
John lewis are currently being vague about whether we'll be charged or not so I was wondering if anyone had any advice or experience with this? They said that they can check the shipping address of the goods but i presume the person walked out with them.
Very worried.....

If the card has been used fraudulently then you have nothing to worry about. I'm assuming from you post that John Lewis contacted you to advise your card had been used fraudulently? If that is the case, its open and shut, simple. You are protected for fraudulent transactions so long as you have kept your details secure.
You mentioned that the items had been brought from Apple using the PIN, then said about a shipping address.....i assume they were purchased online, in which case, no PIN number would have been used.
If the card has been intercepted in the post then it is not your fault and if anything is your CC companies fault for not either allowing the card to be activated or sending out a card that didnt require activation. Either way, if you have never handled the card, then you have nothing to worry about.
Go to the Police and get a Crime incident number, then pass that to the CC company. They will highly likely need this in a fraud case.
Apart from that, i wouldnt worry and id ask your CC company to send a new card out registered delivery to you and to transfer the account to a new one and clear the balance to zero.0 -
thank you for your reply
i have just had the fraudsters on the phone! they called me on my landline asking for my password etc but gave my husbands name completely wrong. even when i said i know that you have stolen my card and i have reported it to the police they still claimed to be from the CC company
so annoying!
i called the CC company to inform them and they have since discovered that the transaction was made in store and with the correct PIN. they cant work out how they got the PIN and neither can i . next step is to check the CCTV from the store apparently....
i have been looking online and I think that even if the CC people think we were negligent (dont see how they could but apparently if they have your PIN they presume in some way you were) then we are only liable for £50. we dont have £50 but it better than £1948 that was fraudulently put through.
is that true? the articles i found were quite old so not sure if this has changed0 -
Ellie. Stop worrying.
You are not liable for anything as already mentioned.
You never had the card or pin - This is a John Lewis problem not yoursIf Adam and Eve were created first
.Does that mean we are all inbred0 -
sounds like they intercepted the card AND the separate PIN notification in the post: could well be a problem in your local sorting office?
(no that I'm accusing postal staff per se: I count a fair few as good friends!).Unless specifically stated all posts by me are my own considered opinion.
If you don't like my opinion feel free to respond with your own.0 -
But how then could they activate it as there are specific procedures in place to combat interception and then activation ?
All sounds rather far fetched to me.0 -

the PIN number was never sent as it was a replacement card. I have no idea how this has happened and how they also have got my landline number.

I hope you are not suggesting i have made this up?!?!
I just wanted to know our liability in a case such as this
the first we knew of it was John Lewis calling us to say they thought that someone other than ourselves had called them yesterday trying to access the account0 -
My amazon card arrived in the post with instructions on how to activate online. The only security I was asked for was my dob and linked email address. Once in, I was able to access my pin as it was on the account. Seemed far too easy to access if you ask me.
What company is your credit card with?0 -

goodness thats worrying! its with John Lewis, i had heard that they were really good with card protection and to be fair it was them that called and alerted us. they said the call they received was at 11pm last night and they didnt call me until 10am today and the transactiob at apple went through at 950pm last night which doesnt make sense as the card would have to had been activated first.
i dont know, i feel really freaked out that someone knows our phone number and all these details and i dont know how.0 -
