A no win no fee firm would progress a claim with the MIB.

Google "injury claim against uninsured driver"

My daughter was hit by an uninsured driver, 100% his fault. The MIB were good. They waited till it had gone to court then paid the full price of the car as it was a write off. She didn't have any medical problems though. So, although it may take a long time to see any money it should come through in the end.

Bear in mind there will be an excess to pay when using the MIB, having said that they do pay up but it can take some time.

    No, this is bad advice.

There is no excess to pay if you use the MIB to claim regarding an uninsured driver.

No insurance often goes hand-in-hand with other offences, e.g no driving licence, no MOT or tax. As you were injured, you must have reported this to the police - do they know the other driver was not insured??

Your legal cover should be able to run it through MIB for you.

If you use "legal cover" to deal with a personal injury claim, the insurer will just pass on your case (for a hefty commission) to a pi claim firm.

You can cut out the middleman and go direct to a pi claim firm of your choice yourself. Many will pay you a commission too for instructing them.

Google cashback injury solicitors. Offers of £300+ are fairly easy to find - and that's just for giving them your case!.

I'm speaking from experience mate. I recovered X amount minus an excess from the MIB when I was hit by an uninsured driver a few years back.

I suggest you read this, particularly the section entitled "Excess": http://www.mib.org.uk/NR/rdonlyres/085DE28C-9F25-4C0C-AE09-500245D5D547/0/MIB_A5_Claim_Guide_Booklet.pdf

Your experience is irrelevant as it's now out of date.

    From MIB website:
For accidents dealt with under the under the Uninsured Agreement, that occur on or after 07 November 2008, no excess will be deducted

As the OP's accident happened last weekend, then he would have no excess to pay as you wrongly keep insisting!

If it were me I would "invest" some money in a County Court Summons for uninsured lossed and personal injury. It's unlikely the guy will have any money or assets but I'd make sure that his credit rating was screwed and stop him buying another car or any other financial products.
