Ebay - Opening a Dispute query

Hi,

I'm wondering what the best way to open a dispute is. Do I go through the resolution centre on ebay or through paypal?

I bought an item from a private seller which was described as unworn and bnwt. When I received item it smelt very strongly of perfume and had a small mark on it, like something had been spilt on it. Listing stated no returns, but I asked the seller if I could return it, as I felt it wasn't as described. They agreed I could return it for a full refund. I returned it 11 days ago and have contacted the seller to request the refund be actioned, but have heard nothing.

Should I contact them again and say I'll open a dispute if the refund isn't issued, or open a dispute now? Hope someone can help as this is the first time I've had to do this and I'm abit unsure. Tnx

Did you return the item via a trackable method?

No, I just obtained a proof of postage receipt.

Then I imagine the seller can deny receiving it and thus refuse the refund.
Any dispute will almost certainly be found in favour of the seller.

If you havent sent it back tracked there is pretty much no point opening a dispute as you need to be able to prove through a trackable method that the seller has received it back. sorry but apart from keeping on at the seller I dont know what else you can do!

I never thought about that when I returned it, was in too much of a rush. Should I just open a dispute anyway?

If you do prepare to lose because 99.9999999% of the time they will find for the seller in these circumstances.

See if the seller admits receiving it, if they claim not to at least you can claim back some money from your COP through RM

Pointless opening a dispute as you have no tracking.

They've probably twigged as there was no tracking you can't do anything.

Disputes opened are recorded both against the buyer and the seller so personally I would not open a dispute as you can't prove receipt.

Ask the seller outright has it been received yet, if not then as suggested above use your COP to start a claim with RM.

It is blooming annoying actually, I had a big flashing warning on my expanded dashboard for weeks about this coming in sometimes last month, this month?

Then of course as soon as it did come in someone opened a dispute as they changed their mind and wnated a refund..but i had already agreed to a return under DSRs anyway. However, nothing is yet showing in the dispute part of my dashboard so maybe it doesn't count as it was merely a return..although my dashboard hasn't actually updated now for weeks.
