    Forget where you were parked. Even if you were sideways across two parent & child bays they cannot enforce their 'charge'.

    It's not a fine and nothing will happen, just ignore the letters and that's that! :T

    On saturday we and thousands of other people decended on Bluewater, we drove around for about 30 minutes looking for a space, all to no avail. We eventually came across, at the end of a parking lane, a marked area covered in what can be described as white chevrons across it. There was no signs sayng no parking, none painted in this area, they were white line not yellow or red and when parked we was not obstructing the traffic, we was totally inside this marked area. After seven hours and quite a bit of revenue going into the Bluewater shops, we came out to a parking ticket from PCM for "parking out of bay". If I am in the wrong I will pay, but reading the latest MSE it tells me not to pay but the info does not quite cover the parking area I was in. Any advice would be greatfully received.
    I certainly would have assumed that you were not allowed to park there. It wasn't a marked bay. Therefore, I guess you were in the wrong.
    However, as Coupon-mad says, you have no legal obligation to pay this ticket or even to respond to them. They have no right to issue you a fine.

    It is up to you to decide if you have a moral obligation to pay up or not.
    Moral reasons to pay: You parked incorrectly. If you are honest with yourself you probably knew this was incorrect.
    Moral reasons not to pay: There were no specific signs saying that you couldn't park there. You've already spent a lot of money at Bluewater and so they've profitted from you going anyway. They should have provided enough legitimate parking spaces. Other people often do it. You weren't obstructing the traffic.

    Like I say, it's up to you.
    You may, to ease your concience, choose not to pay it but to make a donation to a charity of your choice, for example.

    You can incur a parking fine if you park facing the `wrong direction` during the hours of darkness.This is even the case in quiet residential areas without any road markings. At least this was the case 20years ago in Scotland.It is easy to forget about this especially if you car during daylight hours but it then becomes dark before you return to the car.
    I protested unsuccessfully and had to pay a fine.

    Any advice or info would be greatly appreciated.

    I got a parking fine from Southwark Council last week. The paper(ish) envelope was under the window wiper and soaked due to the rain. It was not in a waterproof envelope type thingy as others are.

    When I opened the envelope there was no actual PCN in there at all. I have checked with Southwark Council Parking who have confirmed there is a PCN outstanding although I cannot find it on thier website to check the photos.

    Surely there is a legal issue with the PCN being issued incorrectly here? How would I stand if I appealed this? :mad:

    Well you have phoned and alerted them that there was no PCN in the envelope so I am not sure now whether to advise you to send in an informal appeal saying there was no PCN, only an envelope, and asking for proof a PCN was actually served.

    Or whether to go quiet, wait for the Notice to Owner and then appeal on whatever grounds you can put together including the lack of PCN.

    I would post about this with a pic of the lines and signs where you parked, asap on pepipoo forums for advice on whether to informally appeal, or wait for the NtO and formally appeal (or both). Start your own new thread after registering and reading the FAQs and sticky threads on this forum link, don't reply on an irrelevant thread like you have here (this MSE thread isn't for new cases anyway and pepipoo require new cases to be on a new thread):

    FWIW I would appeal as far as the adjudicator ANY Council PCN, the reason being you pay no costs, there's no risk except having to pay the non-discounted fine if you lose, nothing else.

    And the main thing to understand is that the majority of appeals that go to the adjudicator are allowed in favour of the motorist; in fact those cases where the wise posters on pepipoo give advice are very, very successful in never having to pay up.

  • I would like some help if possible.
    I parked at Derby Railway Station on Saturday and overstayed in the car park. The ticket machine was broken and has been for some time. I was late getting back to my car because my wife’s train was delayed ,I suffer from Crohn’s disease, a form of IBD as a result of which I needed to use the lavatory urgently and I also suffer from Ankylosing Spondylitis which affects my mobility. When I got to the car the ticket had not been issued and the staff were very rude ,finding my disabilities amusing when I tried to explain and carried on issuing the ticket. The ticket is entitled Parking Charge Notice issued by East Midlands Trains for exceeding permitted time: Contrary to Railway Byelaw 14 or terms and conditions. Should I ignore the ticket,pay the lower rate £35 within 14days or appeal under mitigating circumstances?

    Does it mention appeals to the magistrate courts etc because I have never heard of a parking charge notice issued by a train company that is byelaw 14

    Also is the payment to someone else not the train company ? If you could scan the ticket minus personal details and upload it to tinypic, and then give us the link we can help.

    They are all or have been suspended from accessing the DVLA database for gross misconduct!

    This thread isn't for new cases.

    And Rob you'd be well advised to post on pepipoo about this if the ticket was issued by the train company itself (as opposed to a private parking co). Most alleged Bylaw tickets are phoney but pepipoo forums will tell you either way. See the link in post 46 above and when you get there, please read the FAQs and sticky threads first and start your own thread, don't add to an irrelevant thread like has happened here or you will not get your query noticed.

    Court is your appeals process - however if you go to court you better have a damn good reason as to why you shouldn't have had the ticket (if it's just because you don't understand it phone the Constabularys Central Ticket Officer and they'll explain it to you).

    Bear in mind that should you attend court and plead not guilty and you're found to be guilty then your punishment will be far greater than the original ticket fine.

    I parked on a disabled spot only because my 3 year old son had problems breathing due to his health problem, he then started vomiting so we quickly found a spot which was a disabled spot and rushed him to a nearby superstore where they had toilet facilites. When we came back to our car I found a parking notice. I appealed and wrote back to UK Parking Control Ltd (UKPC) who responded back and said that I'll have to pay because I should have noticed the disabled bay but no mention of my sons health issues even though I've also send his medical consultants health warning letter stating he has breathing problems...! I have not paid and over the weekend I received a 'Notice to Owner' from a Parking collections company requesting payment - what should I do, any advice would be appreciated please. Thanks SD12
