Help needed Iqor

Don't send them an I&E form - they've got no business knowing that. A court can insist you complete one - they can't.

Best thing to do there is not to speak to them on the phone. Use another method of payment where you don't have to speak to them - if £15 per month is a struggle, reduce the payment accordingly.

How old is this student account, and has there been a full 6 year period already elapsed before payments or you made any written acknowledgment of debt?

Opened it 4 years ago. They took it off me, told me i had to pay the full amount back as it was no longer a student account anymore. Couldn't pay it, so it got passed onto Iqor. I am still a full time student, so no idea why they took it off me.
I can afford more than £15 a month, but there is no interest being added to the account, where as i have other debts at 34.9% that i would much rather pay off first, so i keep telling them £15 is all i can afford.

I did originally set up a DD with them, but on the first payment they took £115 out of my bank instead of the £15, took them 2 weeks to give me it back, leaving me with nothing for the whole 2 weeks! So i'd prefer to phone every month and pay now instead, as i do not trust them!

I have in the past asked them to keep all correspondence in writing, but they refused that completely!

spudy they will do it all for you and write a letter.
Its pretty clear that on jobseekers you can afford anything.
My brother did the same and CAB were excellent and he just paid £1 a month while he was on jobskeekers.
They have debt experts and will look after you :)

thanks alot man thats calmed me down i thought i was at the end when i saw the letter was scared also if i write to them saying £1 a month and they say no , what then sorry to be a pain

Here's what I would do in your place :-

Have you sent separate CCA requests to Iqor and Apex? If not, then that comes recommended (but send it recorded delivery at the very least!). You'll find much reference to CCA requests and how to word them on this site, and other debt advice sites also.

And an important point - provide no DCA (or Royds TSB) with a signature at any time, for any reason. They don't need a signature, no matter how much they may insist.

If the company that receives the request fails to fulfil it after 12+2 days, then the 'debt' enters a dispute state - whereupon you can legally cease payments until the content of your letters are acted upon in full.

Knowing these two companies, and Royds TSB's stubborn incompetence, your CCA requests will very likely end up lost - if Apex or Iqor bother to forward them onto Royds.

But if you've got proof of sending them, and a copy of the requests you sent (do not send copies of these to any agency that may ask later on), that's all you need do.

Watch Iqor and Apex sharply disappear once CCAs come into the equation - and don't speak to either company (or any other DCA for that matter) on the phone.

Did either of the agencies send you the agreement, or was it from the time it was taken out?

    Who took it off you?

Reduce it, and prioritise the others. Nothing Iqor can do about it.

No, they're not to be trusted. You could use postal order - no signatures, no phone calls.

I have in the past asked them to keep all correspondence in writing, but they refused that completely!

They don't tell you what method of communication you use - you tell them!

It's your choice to make and it's your preference - they've got no say in it whatsoever, and their gripes are of no relevance or interest to you. If they call you, refuse to discuss it.

If you asked Royds for them, then ask for them from the two companies as well.

They may try to say 'you've already got them', but you have the right to ask for a CCA request at any time.

Besides, the agencies sending you the relevant paperwork substantiates their legal right to collect on the debt - and if they can't prove this, then they have no right to collect.

The other thing is - there may be flaws in the agreements as well, which stops them from being legally enforceable.

If you do ask the two agencies concerned, and you receive anything from them, that may be an option to try (but ONLY if you receive anything from them).

I'm fine with keeping it to £15 a month, at least something is getting paid to it, when the other higher priority debts are gone, then i will think about a F&F for them.

Never thought about postal order before, do the post office not charge you to buy them though?

I don't like them calling here, as it's my mum's house. She knows i have debts, but it just all very embarrassing when they phone. I am really tempted to write to them, saying from now on all contact will be made through letters and i will not respond to any phone calls from them. I'm wondering if i can get them to give me account #'s so i can pay them through my online banking monthly? Would they get my bank details though?

Have left some comments, thanks for the advice. Just another thing they keep asking, everytime i phone they go through the "security questions thing" But they always ask for my mobile number to "confirm my identity" Now i know that they have my old number on file, as i never gave them my new one when i upgraded my phone when my contract finished. I always say i don't know it off by heart, cause i don't and i don't have it saved anywhere, plus i don't want them having my mobile number. BUT i've just clicked, clearly they have been phoning the old number and not getting a hold of me, and keep asking for my number to try and catch me out?! Otherwise they wouldn't let me go through with the call if it was a real security question!

EDIT: Another thing i just thought off, i still get a monthly bank statement from the bank of scotland for this account, which does really confuse me, as i thought it was Iqor dealing with it now! But every month it say £15 CHQ cleared....whatever date, so clearly Iqor are just passing on my £15 to the bank of scotland via cheque every month?! I don't see why i couldn't do that myself

PS i am very sorry to OP for hijacking your thread!

    'Security questions' is standard.

Best all round if you don't give them your new number.

IQOR staff are commission jockeys - if they pull in money, they get commission. It's that simple.

So, this account's still open? Sounds like they've changed it from student to normal current.

Few more points you'd made :-

"I'm fine with keeping it to £15 a month, at least something is getting paid to it, when the other higher priority debts are gone, then i will think about a F&F for them."

I’d knock it down to £1 per month, and that way, you’ll get the more worrisome debts out of the way a bit quicker at last. Let them suffer for their greed – they deserve to. Tell them they can like or lump the £1 per month. If you’re scared of calls, there’s a telephone harassment letter you can send them. The F+F isn’t a great idea – I go into why that is in another thread I commented on tonight.

"Never thought about postal order before, do the post office not charge you to buy them though?"

They do. But you’re spending time and money on calls – and probably more than if you were paying via PO.

"I don't like them calling here, as it's my mum's house. She knows i have debts, but it just all very embarrassing when they phone. Telephone harassment letter for the calls – and if they’re discussing your details with your mum, that’s a serious data protection breach. The only phone I’d encourage phone communication is if you had the means for recording the call. Online banking I’ve never trusted – paranoid about identity fraud (which I’ve been a victim of in the past).
