Can I claim against DFS? It 6 years and 6 months ago since taking the agreement.

I was sorting through various financial documents today and shreddng bits and pieces, came across the Black Horse HP agreement with DFS, about to shred it and then noticed in tiny faint writing that I had PPI on the agreement, I had no idea at all, certainly didn't ask for it to be added nor the salesman asked me or my husband about it at the time of the sale.

My husband was self employed by an umbrella company at the time, he worked for a temping agency, Anders Elite and it states Anders as his employer on the financial agreement along with the length of employment - 4 months.

It states in the small print that the unemployment exclusions are: If you have not been incontinous employment for 6 months at the time of taking PPI, my husband was made redundant in the Previous November and got temp work through Anders in December, so the cover was useless.

My question is, can I ask for a refund (it cost £108.65) even though it was March 2004, as I said, I had no idea I had PPI cover so I had no reason to look before now, only looked at it cause I wanted to shred it.

The agreement buy now, pay a year later, so my other question is, is it 6 years from the date of the agreement or 6 years from the actual date of repayment. (does that make sense?)

    yes you absolutely can, there is another DFS thread lower down, have a read of that, has the address you need to write to etc.

    good luck, with such a small amount i dont think you will have much of defence from DFS.. they will just settle up.

    Thank you, I have just read that thread.

    DFS are very naughty, they certainly added this without my knowledge and the knowledge of the OP on the other thread.

    I wonder how many more people are unware of the DFS agreements having PPI on them without their knowledge.

    I certainly hope they settle up, I am really annoyed with them, it may be a small amount, but it is hard earned money, cash is really hard to come by, but very easily spend.

    you certainly can ask for 8% simple interest on top of the premium paid.

    as this is what a court would award you as compensation interest for the loss of those funds over the years.

    On the 28/12/2004 I purchased a sofa and armchair from DFS on interest free credit. I have paid the credit out in full to Black Horse but I now realise that I have been paid 222 in PPI I did not know had been taken out. At no point was anything mentioned about insurance and therefor as mentioned i did not even realise i had this insurance. I was in full time work at the time I bought the furniture.

    I think i can claim but would be grateful of clarification before i go ahead and do so. Also do i write to DFS or Black horse? I cant find a covering letter, does anybody have one for the questionnaire?

    Hi Darren

    Go for it, you complete the reclaiming questionnaire-this replaced the template letter on this site, and you send to DFS head office as these were the ones who set this up.

    Keep copies of all you send and receive, they have 8 weeks to give a decision, keep at them and please keep us posted.

    Ive also had similar purchases but via Ernest Jones and the credit agreement i think with GE money. Anyone know of problems with these guys on miss sold PPI? Just wondering whether to turn the house upside down inside out to find the info as it was similar arrangement to the furniture agreement i think.

    Also just to add if you've no paperwork, you can request for a SAR, they have 40 calendar days to comply and send all they hold on your accounts going back the last 6 years, some however hold details for even longer, but you cannot guarantee on that.
    There is a SAR letter template below, for this request though you enclose £10 cheque or postal order.
    If you had a few accounts with the same company, only one SAR is required.;)

    A quick update, DFS have refused my claim, due to the timescale, it was 6 years and 6 months.

    I have sent the FOS a customer questionnaire and complaint form today.

    I doubt very much I will get the refund now, DFS must be pretty confident the FOS will rule in their favour, they told me in their response "You can of course, take this matter to the FOS....."

    I will update you again once I receive a reply.
