seller sold me duff item and won't refund

Really annoyed.

I bought what I thought was an Epson ink jet cartridge, described as such in the title and a nice picture of an Epson box.

What arrived, by signed for delivery, was a shrink wrapped compatible cartridge.

paid by paypal, no buyer protection shown in the auction.

I emailed the seller, who said I got the right item and he won't refund.

Just so annoyed. I found the item by searching "Epson" and the cartridge type. He'd actually listed it in the compatible catagory, but I never search by catagory and he'd used a false Epson title and false Epson picture. I could sell it on but would only get half what I paid.

To top it all I bought 2!

    Does it say its a compatible or genuine epson cartridge in the description? If it says original then you can claim money back with paypal- goods not as described. Good luck

    title and description say epson cartridge, no "genuine" and no "compatible". Picture is of the correct Epson box, cartridge arrive shrink wrapped with no box.

    Doubt I would win goods not as described as there is no paypal buyer protection logo in the auction. Can't claim non-delivery as delivery was signed for. Don't want to risk another paypal dispute, had one this year and your only allowed 2 AFAIK. Funnily enough my only previous dispute was for an Epson cartridge, Guy sent wrong one, I sent it back and he promised to send correct one but it never arrived. I filed with paypal as the protection logo was shown, but they wouldn't accept it.

    All I can do is cut my losses and sell the cartridges as compatibles. If i neg him he'll lose his 100% but he'll probably neg me back and I'll lose my 100%.

    I can only suggest that you leave neutral feedback saying the photo was misleading.If the cartridges were alot cheaper then in store epson originals then perhaps you should of realised that they weren't genuine.It would probably be best to mail any future seller you use,to see if they are genuine cartridges to save you going through the same situation again...Damian

    I think you can have more then 2, and don't neg him, either neutral or positive but say "item not genuine, but was as described" as from the sound of it, he hasn't lied in the auction, you not checking it througoughlly is not a reason to neg him and if you do, tbh you deserve a neg back for being an incompetant ebayer

    I'm staggered that people are saying not to neg this character and that a paypal dispute might nbot be won.

    He used a picture of a genuine Epson box!

    How can the item possibly be as described if it does not look anything like the photo?

    I would:

    a) Neg him
    b) Complain to ebay
    c) Start a paypal dispute
    d) Inform Epson

    His use of a picture of one of their boxes to sell something completely different is fraudulent.

    I agree with Moglex, just because a seller does not have the 'paypal protection' sybol doesn't mean you are not covered. I'd certainly give it a go.

    As for he two (or is it three claims a year?) when this is done, close your paypal account and open a new one with a different email and bank details.

    Paypal knock off the first £15 of a claim apparently so its not worth claiming.

    Today's developments: Got in touch with the other buyer of the same item. they also were expecting genuine Epson and have been refused a refund.

    I emailed the seller again today and told him I would be contacting Epson customer services tomorrow, to report him for using their pictures with a compatible product, if I don't get a refund today.

    He has just received a negative feedback and made his feedback private. tried searching through his recent sold to find it but there is too many. Goofbay and toolhaus don't seem to find negs in private feedback anymore, so I can't find that buyer.

    At least with private feedback he can't sell, so bang goes his Ebay shop.

    How much was he charging for them? The old saying: If it seems too good to be True...... springs to mind. I personally would only neg as an absolute last resort,try claiming through ebay and paypal before giving a neg...he might be swayed by them....Good luck

    I suppose it's a matter of opinion, but I would have thought that anyone using a picture of something that they are not selling is indulging in fraudulent behaviour and should be negged at every opportunity.

    Why do you feel that negging, which is the only realistic way of letting other potential customers know what he is up to should be a last resort?

    Do you think he should be allowed to con other people in the way he as conned the OP?

    Nope - That's if you claim from EBay with a non-paypal dispute. You get the full lot back with Paypal- I always have and I've certainly had more than 2 disputes a year!!!
