Damaged car - paintwork

You should have offered them a cash offer at the time, there and then.
Say you said to them, I give you £100 cash now for settlement and agree that would be it, get him to sign a statement hand written on paper dismissing any further claim towards you.
Now as others say, you are looking a few hundred quid easy!0 -
Remember, the OP offered to pay for the damage, the other driver could easily claim from the OP's insurers, which is what I would do, if I was messed about as some of you are suggesting.
The OP just needs to pay up, or await a claim.0 -

The O/P is going to have to bite the bullet and pay.0 -
If there is a rust problem, I am not sure I'd be offering to foot the bill for that - yes, you scraped the paint and should really be covering the cost for that, but if there is an underlying rust problem that needs treating, that isn't as a result from your dink.
there may be a underlying rust problem but the OP damaged that panel if the third party wanted it fixed, then thats how it would be done. regardless whether a rust problem with the panel existed, the op made worse by colliding with it taking more paint away exposing more metal for the rust to spread even more. a repairer wont paint on rust. if i were the third party and op said to me yeh i hit you my fault ill pay but as theres rust on the panel that was there before im not having that repaired, i'd be inclined to claim off her insurance, car may be written off but i'd get a pay out for another vehicle, causing op to lose any no claims, hike her insurance, incuring op 3-5 years of declairing the claim of at fault costing hundreds over that period. so the op's best intrest to sort out outside of insurance she will have to cough up for the rust to be treated or a new panel and painting.0 -

No doubt you'd remember you were actually in the car and have severe whiplash along with mental trauma including flashbacks of the event too, eh? *rolleyes*0 -

Yes....I am sure a little bump in the supermarket could totally lead to the car being written off due to a rust problem and that clearly would be OP fault so they should stump up for the entire new panel...or perhaps the car owner might sugest a new car would be a suitable option:rotfl::rotfl: seriously?? the rust problem is not OP fault AND if the rust problem is so bad the car needs to be written off perhaps the owner should have carried out some better car maintenance in the first place and could have been driving a dangerous vehicle, so in fact, OP might have just save their life and they should pay OP as a thank you...:rotfl::rotfl::rotfl:
OP bumped the car - yes, the rust problem was not caused by OP and therefore treating it is not the responsibility of OP. AND if you make a claim on your insurance it does not necessarily wipe out your NCD or automatically cause your insurance to sky rocket...Feb 2015 NSD Challenge 8/12JAN NSD 11/16

dont take my quote out of context.
IF car is OLD insurers wont bother to repair even the smallest of dints and scrapes so yes more likely be written off if insurers were involved insurers look over the whole body condition not just damaged area when tallying up the cost of it all.
AS SAID NO REPAIRER WILL PAINT ON RUST UNLESS A BACKSTREET 30 POUND JOB and the painter has no respect for his work.
only op knows how much rust is on it. but if the dent is inside damaged area by the op a repairer wont just paint over that rust and will treat and fill at the very least all adding to the cost of repair.0 -

wow certainly know how to hike a situation, from supermarket dink to saving a life from a bit of rust. ive seen 54-55 plate KAs with rust bubbling above the plastic arches and down bottom of doors. just coz theres rust doesnt mean its not maintained in a roadworthy condition. all im saying is that 1. this car may not be old as we think, 2. scraping a panel exposes at least a little metal and that little bit is all that is need to expose it to the elements and for rust to spread. 3. a decent repairer will not paint over rust.0
