Can anyone help please

i bought a mobile phone on an 18 mth contract after a few mth it broke down(speaker stopped working)it was sent back and fixed or so i thought. it continued to happen twice more ,thats when they told me that they would replace it
what they sent me was a joke a second hand set worth far less than the origional and i wans`t able to do the things i had on my origional phone as i was still paying the contract fee you can guess i wasnt amused. when i contacted them they said that i would have to wait a week to see what they were going to do again not happy
not only that but all the stuff i had downloaded and paid for were lost

anyone any idea where i stand on this

    You should be asking for a replacment of equal or greater value with broadly similar functions. Remember though yours is not a new phone it's a second hand phone.

    The contract for airtime is a seperate contract to the contract for the supply of the phone, so you've little chance of getting anything done to that side of the deal.

    You can cancel your dd, but they will still chase you (ruthlessly) for the money! (You are now paying your monthly service contract, not for your phone)

    Instead you need to escalate the matter to get a replacement that is equal to the original spec of the phone you signed up for.

    I wouldn't cancel the DD. I would ask them to explain exactly what they are doing to replace your handset. In the case of Orange I have personal experience of them giving a small credit for downloads. My phone had to be replaced and the game I had purchased for £5 couldn't be backed up so they credited me with the £5.
  • I did what some of you said..put my foot down, stood my ground and asked them what they were going to do for me and suprise suprise they are sending me a brand new phone on monday (same phone as my origional one)
    WOOOO HOOOO how good is that.
