Can I reject New Car as being unfit to drive?

Unfortunately that's not how the SOGA works. Car, washing machine, TV etc, it makes no difference, the seller would be entitled to offer a partial refund based on the amount of use that was had.Suppose it wasn't a car but a washing machine that broke after 7 months, and then repeatedly failed despite supposed fixes.
I doubt many people here would argue for anything less than a full refund, what makes a car special?0 -

Hi The first 2 times no, they were just on low speed. The second time, it was literally about 3 seconds after I turned them on (I was parked and not moving, put the wiper on slow just after turning engine on and wasnt driving!).0 -

Do you have finance? Did you pay any part of the cost on a credit card?
I thought I had paid the deposit £300 on my credit card but cant find proof of that,, but also have a sneaky suspicion that I may have paid cash :mad:
No I dont have car finance on it.... does that mean im more likely to receive full refund or not?
They reduced the car by £3600 for giving them my old car as scrappage scheme. I would be happy to have the cash I paid plus my old car back (but they wont be able to do this). so not sure where I stand.0 -
Find your statement, if you did pay the deposit by credit card then the card company are jointly liable with the dealer. Ring them and get them involved too as they can often put way more pressure on the dealer than you ever will.
I think s75 of the Consumer Credit Act is the applicable legislation to quote in your phone call.0 -

This is where things are going to get difficult, by using the " Scrappage Scheme " the financial side of this is complicated....
I suspect that they may offer the amount paid, less the £2000 scrappage award, assuming they agree to a refund.0 -

Found it! yes paid £300 on my Virgin Credit Card... At what point do I contact them ? The car is currently still with the garage (this is the 4th attempt fix), I was going to give them this last chance and if (or shall i say when!) it happens again then reject the car.....
Do I contact virgin now, or next time ? (Is there a time limit?)

Surely if the car was valued at £2000 under the scrappage then they need to give you your original car back, or the £2000 value of it?0
