Mobile speed camera question

Just received a NOIP from Bradford MBC. Camera shows I was doing 36mph in a 30. Taken from a mobile camera in a car,

As far as I'm aware there were no signs showing the speed cameras operate in the area. What can I do to contest this? I did spot the car but after the event and I honestly don't know if I was speeding or not.

I have seen the photographic evidence but there is no info on the website to show the certificates for the calibration of the device.

  • You were caught speeding - just because there were no signs to say speed cameras were operating in the area is no defence.

    Yeah you should just pay it, if you were pulled over you could hardly say that they didnt have signs saying that you might be pulled over if your braking the law. Next time pay more attention or simple dont speed.

    I do speed (occasionally) and know if i am caught i will have to pay the consequences and wouldnt waste anyones time by trying to squirm out of it like a little worm!

    p.s. got caught doing 46 in a 40 zone in east riding. Delayed replying till quite late. 2 days after i sent the letter back recieved one saying appologies you were'nt actually speeding (think i was) they must have found a fault with the machine or it couldve been something to do with the chief of east riding police (could be yorkshire?!?) getting caught doing 140mph the week before?!?

    Signs are not required. I assume you have received a S172? If so ensure that you complete that and return within the 28 days.

    At that speed you may be offered an awareness course, so might not be as bad as you think.

    I assume the NIP has been received within the time limits set? Unless there is good reason for it being delayed...
  • Thanks for the responses. I'm not convinced that I was speeding though so don't really want to just "pay up" as advised.

    I agree that if I was speeding I should just accept the consequences.

    Thanks KWAKS for being the only person to answer my question and not lecture me. Yes the NOIP was received within 5 days of the alleged offence.

    I have returned it today along with a letter requesting further information.

    Bear in mind that you are not entitled to any "evidence" to be disclosed until such time as you have entered a Not Guilty plea at court.

    Did you give your details as driver and sign the form ?

    If you have made any sort of conditional statement in the letter, you could end up with a prosecution for a s172 offence, and be looking at a much larger fine and 6pts.

    I don't think I have made any conditional statements just asked them for info to support what they say on their website about mobile cameras being "clearly highly visible". The photo they have shows a car in front of me and several parked cars directly behind the camera van.

    Yes I did give my details as driver and sign the form - should I have done? I don't dispute that I was driving the car on the road in question.

    I don't want to end up paying a larger fine and getting more points so I think I may just send the form back and accept the consquences .....

    That's irrelevant to the speeding allegation - they don't have to be visible at all.

    If you think you are not guilty, you should still return the form stating you were driving (which you don't dispute) ... you will then receive an offer of a fixed penalty (£60 & 3pts) or most likely at that speed, an invite to attend a Speed Awareness Course (costs you but no points).

    If you wish, you can then reject the offer and elect to go to court, and plead Not Guilty
  • Thanks for all the advice. Am just going to send the S172 back for now (without any letter) and make a decision about what to do when the prosecution notice comes through.

    The important thing at this stage is to comply with the section 172.

    Bit confused about the pic you described, was the speed taken as you moved away from the van? Or is that just the ID pic?

    Do you remember the van at all? was the window open to allow the speed to be taken?
