Help! I got a letter from moorcrfot today. Should I call them?

  • I know I know. I do need to calm down but I have found it all so frustrating. Is my debt statue barred if I was paying off £10.00 a month from June to September? As that was me acknowledging a debt? I can send the statue barred letter as I doubt moorcroft will have that info from hsbc. I'm just very confused. If I send statue barred letter will they acknowledge this as it seems they bought the debt off hsbc and have used scare tactics to worry me into paying. I don't want too!!!!!! Thanks for the advice, I'm suppose I'm unsure if I'm statue barred or not. I have never said in writing that I accept the debt from hsbc ever but have spoken to them on the phone but probably not for about 4 years. Thanks again for putting me at ease.

    Debt collectors want to talk to you on the phone , they can then lie , bully , threaten , intimidate , misquote the law , be very overbearing , that is why you never talk to a dca on the phone .

    Was there a period before this June of six years where you didn't make a payment or acknowledge the debt yourself in writing?

  • Yes. A year previously before the June for a period of of about a year I paid £20 a month. That lasted a year. I never accepted the debt in writing. I don't think I qualify :( what do you think? I didn't talk to hsbc about paying off debt, my mum kept getting calls and then I knew I had to pay something off. What do you suggest I write back to moorcroft? I found a letter on national debt website about debtors not accepting first payment- would this help? Thank you, yes I know I'm useless!!!!! But I'm trying to figure this out alone!

    send them a statute barred letter .

  • Thanks fo the advise, I have the statue barred letter in hand but should I send it if I have already sent 6 letters offering to pay something? As statue barred is saying I don't accept the debt. Sorry for being useless. Shall I send the statue barred?

    Send it. The worst that can happen is they prove its not (unlikely), then you're still in the same boat as before. Send it today if you can get to PO before it shuts, and remember, recorded delivery :D
  • Ok, update!!!!! I have 2 letters from them saying they will investigate my claim of statue barred. What do I do now????? Just wait for another stupid letter? Obviously they don't no I left uni in 2002!!!!! Hope they come back with no evidence! Thank you for the advice everyone
