Help! I got a letter from moorcrfot today. Should I call them?

  • I resent 2 letters yesterday and just missed a call from them!!!! They of course left a nasty message. Will I get the written confirmation I am waiting for? I do not want to talk to them I just want to pay my debt and end this mess. How long do I hold out for this? I have sent 4 letters offering a full and final settlement but I know I should not talk to them on the phone, it's just so forbidding, having this hanging over my head! What to do?

    Do NOT speak to them on the phone - nothing can be achieved with this.

    As sofababe's already said, if no payments or written acknowledgement of debt has occurred in a full 6 year period, it's statute barred.

    And if it's statute barred - that means that Moorcroft and their client can do nothing to you. They can threaten all they want, but they know that they're powerless.

    You can find the 'statute barred' letter easily enough on either this forum or other site forums. They have to prove that a valid and enofrceable debt exists to you - you don't have to disprove it to them.

    If you send the SB letter off (do it recorded, and get online proof that they receive it), and they contact you for anything else other than your letter, you can go the formal complaint route.
  • Seriously what is wrong with moorcroft??? I have now sent 6 letters offering money and yet nothing from them???? Do I hold out??? I know they have been delivered as I have sent all letters recorded. It is truly ridiculous- unless something arrives today?!

    If you haven't sent the SB letter off, I'd send that recorded ASAP.

    Then if Moorcroft continue to be stubborn, report them to the OFT, Trading Standards (your local one and Stockport's as well), and the Financial Ombudsman Service.
  • No I haven't sent that one yet as I had been paying bits off through out the years (literally when the bank got hold of me!!!!!) so I didn't know if I qualified for statutory barred? But I hadn't paid for about a year so it's just so weird! It's a student overdraft and I qualified in 2002!!!! So that's 8 years of having the overdraft and I just left it. So silly. Good idea about contacting OFT I mean if they want my money- take it! So that I can move on with my debt. Thanks for the help, I have had
    No more phone calls from moorcroft though, don't know if that's a good or bad sign!
  • Ok, I arrive home for the weekend and find the lettter from moorcroft. I offered 700 quid from a 975 debt and the letter they return is one asking for a list of income, current debt, current creditors, whom will be assisting me in paying off the debt etc. What do I do??? I don't want to send them this information, it's personal and not for a dodgy debt collection agency to know. I don't want to have to pay the whole amount off- again this debt is 9 years old!!!!!!! Plus I was planning on paying them by credit card (yes I know more debt) but I don't have 700 or 975 off hand, and I was planning on paying this back by getting a 0% balance transfer card and paying it back over a year-interest free. What should I write back to moorcroft? They obviously want the full amount but surely a 9 year debt repaid in full is ridiculous?! Any advice greatly received!!!!

    If there's been a full 6 year period (5 if you're in Scotland) where no payment or written acknowledgement of debt has happened, it would be statute barred in any case. If that is the case, Moorcroft should be sent the Statute Barred letter.

    No, you don't have to send them (or any other company, for that matter) details of your financial I&E - you would only have to give this information if you were in court.

    Hsbc over the years but I ignored it. So I should accept responsbility. So what do I send back to moorcroft? Do I offer the 700 again? And that's it. I don't want to pay the whole amount!!!!! Reading on these forums people have in the past,got a lower settlement offer so how do I achieve this?! I will not be sending them my financial info. As that is private but how do I get moorcroft off my back!!!!!

    Was there a period of six years where you didn't make a payment or acknowledge the debt yourself in writing?

    Letters from creditors don't count. Nor do phone calls, unless you made a payment.

    If there was such a period, then the debt is statute barred. Once barred, it doesn't matter what you later do. It stays that way, permanently.

    I think you need to take a step back , calm down and take a deep breath , you are not listening to the advice given up to now , a debt is statute barred if there has been no payment by you , and no writen acknowlegment by you , in six years , notice i said by you , they can send a hundred letters , it sounds to me this debt is statute barred , send the statute barred letter , if they come back saying it is not statute barred , then send a prove it letter .
