  • Thankyou, just concerned that if I offer less than the debt than they will sell the remainder onto someone else? Did that happen to you? Of course I will write in the letter stating that when payment is received that will be the end of this matter. And after their confirmation I will pay. Fingers x they accept 50% thanks again

This is the reason for offering a Full and Final Settlement. Use those words

Full - it is accepted as complete payment
Final - there is no more payment to be made

Get it agreed in writing before you pay anything.

Once you have paid, keep your evidence of having paid and the agreement in writing for at least 6 years. If anyone comes after you, write and tell tehm that a Full & Final Settlement was made and keep a copy of that letter. Then ignore them. If they should be stupid enough to take it to court, your letters and the evidence of payment would make tehm look really foolish.

  • Thankyou for all the kind advice. I sent two of the same letters recorded this afto. Offering an amount that was 275pounds less than the original. I do hope they accept this?! I felt better for this but then literally 5mins ago, I'm washing up and I get a missed call. Guess who left me a msg? Moorcroft????!!! I have deleted the msg and will not be speaking to them on the phone. Like you hAve all said, don't talk to them on the phone!!! So they will get my letter Wednesday, which was when the 7 threat days were up so I will await their contact and hopefully feel a little less stressed. Could not concentrate at work today, felt very uneasy like a Baliff was coming to get me :( I know mad, bug thus has never happened to mebefore, but this incident has really opened my eyes to how many people are in debt and hounded by !!!!!!!s like moorcroft!!! Will let you know about what I get back. Thankyou all again
  • Update- I sent a letter offering a full and final settlement offer. I sent this letter twice using recorded delivery (for my peace of mind!) and I get a letter back on the 21st saying they have not heard from me!!!!!!! Lies as I know it's been delivered. So I thought I would give it a few days incase my letters took a few days to get through and I have not heard from then, no phone calls. So I resending my original letter (twice) recorded delivery tomorrow. Are they doing this to me on purpose as they want me to call them? What should I do? I thought offering a full amount would satisfy them? And I know the letters were sent & received.it's ridiculous, what's wrong with these people?!!!!! Any advise greatly received

If the letters were sent recorded and you have proof that they were deilvered then there is no need to send any more letters.

I think that you should just wait for them to make contact as you are the one holding all the cards because you are offering full and final settlement.
  • Thank you, but because moorcrofts threats are scaring me. I'm resending 2 more letters tomorrow. Just hope then I get a reply, the letter I got on the 21st was about getting solicitors involved and it worries me. I just want all this nastiness to go away. I sent the original letters recorded post so I have only assumed that they have been delivered! They must have been. Moorcroft truly do bully you into scaring people but I won't call them. That's what I think they want. Thankyou for the support and confirmation that the ball is in my court.b

Solictors are just threats stay strong because you have offer to pay them. I once had a DCA make a very nasty threat to me and this turn out to be just a bluff.
  • Well I will send the letters again and wait for a positive response. Or more threats!!!!! Hope not. That's just it I'm offering a settlement and yet- no positive response. Thanks for the sensible reply, I will see what the post brings tommorrow.p

These kind of companies throw threats around like you wouldnt believe, hoping that in most cases, they catch someone like yourself who panics about it and pays up straight away! I did when i was first chased by them but remember the following:
1, They can send a debt collector to your door but you are under no obligation to open it or to speak to them.
2, If they do not leave you have the right to call the police as you are feeling threatened and intimidated.
and 3, You mentioned a threat of bailiffs and we are only looking at phone calls and letters to and from Moorcroft at the moment.

Let me clarify something with you to hopefully put you at ease, a Bailiff is a court appointed officer sent to a place of residence to obtain payment or goods in place of payment for a person who has violated the terms of a County Court Judgement (CCJ). Bailiffs will not show up at your door now, or anytime soon. You havent been summoned to court so have nothing to worry about.

The phone calls, just ignore, you have written letters already, and if you feel better, write some more, it wont change anything. Have you been onto royal mail tracking to check the signature and time/date of delivery of the original letters, just to make sure?

At the end of the day, they send the style of letters you have received to make people like yourself, good people who dont like confrontation or people being forceful towards them, demanding payment, in the hope that they will hit a nerve and the person on the end of the phone will hit their target for the night of collecting debt. Trust me on this, years ago i did temp work for a debt collection agency. I did it for 4 days and quit, they said i was too nice to the people on the end of the phone, but hey, thats me!! :)
  • Thankyou. You have put me at ease. Just worried as the address moorcroft us my mums address and heaven forbid someone turn up and scare my mum and I worry that because I'm a teacher somehow this will taint my career?!!! I know mad mad mad thoughts which like you say probably won't happen! I will check royal mail, track and trace and re send more letters. I just want to make it clear that all communication between them and me will be written and that I'm asking for confirmation from them that this will be the end of my debt with them, before I make a payment. The letters they have sent me so far do say pre court division so obviously it'd not next level yet. I just don't no how anyone could work for a company like this, I totally commend you for leaving after 4 days. It's a nasty job that just doesn't take in feelings or individual situations. Thank you again for the advise, this forum really is a life line for so many and especially me!!!!
