esa help please

was told i would not be able to work for nearlly a year at a min due to a prolapsed disc which needs an op to fix.

so i spoke to jobcentre about esa. they said i would be eligibale for it so made me a claim. i have to provide a sick note to them but when do i have to give that in?

also when do i start getting money also when will i have my medical and do u get money before medical or after?

im not to clued up on it really and the lady on phone couldnt really tell me.

when i i have to have interviews etc and do i have to go and sign on every week etc?

    Fit notes cant be back dated so you need it NOW if you have applied for ESA.

    There is no signing on and the medical is in week 13 (depending on local constraints it may be later) and no interviews but you wont get past the medical with just a prolapsed disc unless you have major nerve impingment, no bowel or bladder control etc.

    Dunno about the sick note, but I imagine you need to get one from your doctor pronto and follow instructions from your ESA BDC

    AFAIK you get paid before the medical, as long as you have your sick note and only for the dates certified by the sick note, then you will have to renew your sick note to continue getting paid- and assuming your claim has been processed.

    You don't have to go to sign on but you may have interviews with someone on occasion.

    Assuming you applied for ESA over the phone? Not done by the jobcentre?

    yh i applied over the phone.

    with my prolapsed disc i have has siatica in both legs and hardly no control over bowel movements.
    also i have weekness in my left arm

    also i will have a operation aswell which will keep me off work also

    how do you know i wouldnt get throught wil prolapsed disc.
    i doesnt allow me to sit for long periods, walk for long periods and also the ability to drive, lift, also with the siatica i have some times i cant stand or get stuck in position
    and some times my legs give way.

    i cant see how they would say i would be fit for work when a specailists says im not and also my doctor. and also the need of an operations and spinal cord stimulator to be fitted

    Lot's of people fail the medical, and have to appeal, many who appeal are then awarded ESA.

    BTW if you miss the medical you can't appeal.

    i wont miss the medical.
    i have read everywhere that most people get rejected and even bbc have been looking into it as number of mps, doctors and specalist believe that atos healthcare arnt doing the assesment proper and not doing the form correct resulting in rejections and then appeals. they are saying that most of the appeals are now being granted esa

    you would think the goverment would look at this

    My husband has stage four kidney failure and a lot more but he failed the medical, hes not alone and cancer sufferers with months to live have also failed, thats why I posted that you may fail the medical because anyone can.

    I will be transfered to ESA in the next year or so and I am in a wheelchair fulltime, I cant use a manual wheelchair due to lack of function in my neck/arms/hands, Im deaf and i have major pressure/bowel/bladder issues + more but I might fail the medical, so might every other person claiming ESA so dont assume because your (one?) specialist supports you that, that will prevent you being found fit for work.

    oh no i understand that, my bro inlaw has rsd and is wheelchair bound, they didnt wnat him to do a medical and the dwp sent him a letter saying his doesnt have to do a medical or menatal assesment.

    i have looked at there sections they look at on comp. and you would easily score 15 points

    as i would and most others would, thats why a lot of people have appealed and won

    Unfortunately it's not as simple as that. If it was you would be seeing a high pass rate at the medical stage and at the appeal stage.

    If I remember rightly, if you include those that pass the medical and those that pass the Appeal Tribunal, only about 38% of all of the ESA applicants get onto ESA 'proper'. The rest either claim JSA or find work. And as the other poster said, those that pass at either stage are very ill with complex medical conditions.

    Just take it one day at a time, be honest and truthful and above all - expect to fail! If you don't then that is a bonus.

    Fit notes can be backdated, my doctor backdated one for me several months when I applied for ESA, and ESA backdated payments for 3 months (the max, the sicknote was backdated even longer).

    However, they wont do it, unless they have evidence it applies (ie you had to have had the condition/symptoms back then, they are not going to just backdate it if you turn up for the first time and mention something, they have to have it on record that you did have the problem for the period they are backdating)
