    If my son was say living with my parents in a private mortgaged property he wouldnt have to pay rent or council tax. Council tax is banded in properties, its not on the amount of people that live in the house. Also my son is not mentioned on my tenancy agreement so surely doesnt have to pay rent. If it is the cass that he has to pay these bills then who pays me for his food, electricity,gas,water,clothes?

    Council Tax charges are based on the property band but the number of occupiers can and does affect the charge when it comes down to discounts (single person discount etc.

    If your son is not a joint tenant then he has no council tax liability and cannot claim council tax benefit - has he claimed it in error and its now being re-claimed from him?.

    If he is being shown as jointly liable for council tax then this is incorrect.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.

    Thanx for yr replies but ill stick with talkin to CAB. They talk sense to me. I certainly cant afford the extra they are asking for, i myself am only claiming ESA and Child tax credit thats not even enough to live on for me and my youngest son let alone having a 3rd person in the house who isnt contributing to the bills in anyway!!!!!!

    Hi Sarah, some of the above posts are wrong and the CAB is correct. Because your son is claiming JSA (income related) you are still entitled to the same amount of benefits you would receive if he didn't live with you.

    Our adult son (19) moved back in with us a few months ago and there was no change to our benefits whatsoever. My hubby is seriously ill (incurable and life shortening) so claiming ESA, DLA and I get Carer's Allowance. My son is in reciept of ESA because he too is extremely ill although when he does recover and goes back to work he'll have to make up what we'll loose.

    I thought that you were also claiming HB and CTC? What about Child Benefit and maintenance from the child's father?

    AA was correct and it has been explained to you several times now,

    YOUR BENEFIT ENTITLEMENT WILL NOT CHANGE AS YOUR SON IS ON INCOME BASED BENEFITS, HOWEVER, IF AND WHEN HE GETS PAID EMPLOYMENT, THIS WILL CHANGE...

    That clear enough for you now? *rolley eyes*

    Didn't i read somewhere in the budget, that from april anyone who claims benefits in their own right who lives in the house will have an ammount deducted?

    Non-dependant deductions from HB

    No deduction should be made from your rent rebate or allowance if the non-dependant is under 25 and on Income Support or income based JSA.

    But.....if the OP is claiming single adult allowance on council tax, surely her son is now a 'second adult' in the home - and therefore, the 25% discount will be lost? Whether she qualifies for full ct after that or not - I don't know - but the 25% discount would be lost as there's no longer just ONE ADULT living in the property.

    Re bus fare for interviews for the OP's son - there is some situations where the transportation cost can be claimed back - he might want to check that - not sure if it's based on the cost, the mileage or what.....but might be a help to him.

    Oops....forgot you are sticking to the CAB - sorry for contributing!

    If the 2 adults are parent and adult child and the adult child receives an income based benefit, (ESA(IR), IS or JSA) they can claim a 25% council tax discount.
