    Is incorrect. It is only unlawful if the fact that holiday pay being rolled up isn't disclosed and the amount isn't shown on the payslip.

    Employers NI is over 70p. Holiday pay is double that. They'll be lucky to be making 39p per hour which has to pay for the office, the staff and all the running costs of the agency.

    No it isn't. I've done about 12 years with agencies since 1993 and none have included holiday pay in with the hourly rate.

    Ditto. The 'one' being Hays Recruitment in my experience. Office Angels always told me the actual hourly rate, then I got holiday pay on top. Hays like to make their rate looks better by adding in the holiday pay as "inclusive of benefits". Holiday pay is NOT a benefit, it is a legal requirement!

    If the rate includes holiday pay, this is about 110% of basic rate (very rough calculation presuming minimum holiday allowance applies).

    Office Angels also told me what my hourly rate was when I did 21 hours work for them (over 3 days), they paid me exactly that rate x21. I've since left (got perm job) and they have emailed to say P45 will be sent along with 1/2 days pay I accrued as holiday.

    A reputable, professional company in my view. Yours doesn't sound as if it's been exactly 'up front' - or you misunderstood.
    Seen it all, done it all, can't remember most of it.
  • When I worked for well known agency, my holiday was accrued and not included in my hourly rate. When I stopped temping and went perm with the company, my accrued holiday pay was paid to me in my final pay from the agency.
    Debt 30k in 2008.:eek::o Cleared all my debt in 2013 and loving being debt free :)
    Mortgage free since 2014 :)

    Holiday pay should be 12.07% so £12.49 would roll upto £14

    Why not just take some holidays hours every week to get this paid if that's what you want.


    What other agencies do is irrelivent the job was advertised to me as £14ph including holiday pay.

    unless they go through a service provider where it majority be profit

    depends what type of agency and what department you work for!!!
