Temp: inclusive holiday pay query

I took on a temp role with a new agency which was advertised to me as £14ph including holiday pay.

I've just been paid and it was lower than expected. A query with my agency revealed that "Your rate is £12.49 plus holiday pay, which is accrued, and claimed when you take leave."

I'm not saying this isn't by the book, but I feel they have duped me somewhat. I'd rather have the £14ph paid in full, even if it does

mean I can't claim holiday pay later. I wish they had told me this up front.

Does anyone else think they misled me?

    Ah - but giving you the money up front and not paying you for your holiday would be unlawful. So regardelss of what you would prefer, you can't have it :( So not really misleading, I think - more that you didn't understand what they said. If you had known that they couldn't pay you the "all-inclusive rate" then you would have expected this and could have asked more questions about the actual rate.
  • Being paid holiday pay when you're a temp is a scam. I was working as a temp when the holiday pay legislation came in and my hourly rate didn't change from one week to the next. All that happened was that my original hourly rate was split into two parts: "pay" and "holiday pay" on my payslips.

    I've worked as a temp since, for more than one reputable (allegedly) national agency and have never had my "holiday pay" retained until I chose to take any time off. If only!

    Seems a bit odd.
    Usually the agency takes into consideration the cost of holiday pay and passes it on in the fee charged to the client. Never heard of it being deducted from the temps hourly rate of pay.
    Ask them what the hourly rate is that they are charging the client.

    There is a way around this and the best way is to go through an umbrella company and you will get paid your basic rate with holiday on top at once. I would say if your earning over 12 quid an hour its worth while using the umbrella service. I found it usefull :-) I used 'Danbro' as my umbrella google them..

    You don't get paid holiday pay in with your weekly salary, this is just your hourly rate by how many hours you have worked that week.

    You accrue holiday with each timesheet that you submit which works out roughly 1 day per 2 timesheets (depending on the agency).

    You can then take your holiday as and when but you must have accrued it before you take it.

    I've employed temp staff via an agency. They charged us £8.89 an hour but only paid the employee £6.50. I'm guessing the higher figure what they're charging employer then taking their % out prior to paying you.

    you have to take into consideration employers NI and other overheads.. Its not all profit

    They advertised right £14 p/h 'INCLUDNG Holiday Pay) - you misjudged it... All hourly temp workers Holiday pay is included in pay

    I've worked through numerous agencies and only one included holiday pay in the advertised rate.

  • I used to be a temp and earned say 10 pounds per hour which is what the company I worked for specified as my hourly rate to the agency the agency charged the company say 15 pounds per hour and that consisted of ni contributions money for the agency and my holiday pay which I accrued at about .4 of a day a week.

    So I got holiday pay on top of my hourly rate - maybe you could ask your manager what they believe your hourly rate should be?
