Trying to cancel my contract HELP!!!!
Hi there,
Been with O2 at the CPW for 3 years now. My contract was due to expire on 19th aug 2010. I called to sort out cancelling as ive already taken a contract out elsewhere with o2 again.
I seem like im struggling to get a answer or any help in leaving them but eventually i figured out i needed to send a letter of cancellation which i did so at the end of aug.
Its now approaching november and ive been charged twice so = £70 and im not even using the phone, the sim isnt even in a phone! I called up o2 at the CPW who say they must not of recieved the letter of cancellation but if they did i would be refunded.
ALL I WANT TO DO IS LEAVE THEM, why is it so EASY to join them but mission impossible to leave?
Ok so what do i do now? presuming they have 'lost' my letter of cancellation? not sure what steps to take, i dont want to send another letter because i want my £70 back.

When did you call?
The contract doesn't expire, you need to give 30 days notice. If it's not actioned you call back and request a refund for charges post the date you should have cancelled.
If you gave notice at the end of aug, that means that your earliest cancellation date would have been 30 days since then. You wont get £70 back as you could have avoided the first £35 by writing or calling in time.
Get on the phone to them tomorrow- they will have a record of mail logged on your account, so can't take long to resolve.0 -
Did you send the letter recorded delivery? i.e. can you prove you sent it?
If you truly believe you cancelled the policy in the appropriate manner as per your T&Cs just phone your bank and ask to do a Direct Debit Indemnity against the two payments they've taken.
Tell your bank your contract ended in August but they still took September and October and they will refund you within 48 hours.
Best of luck0 -
1) Cancelling the direct debit could you you in a MUCH worse postion - it is a fundamental error though oft advised by people on here.
2) Get it in writing (recorded dleivery and check receipt) without delay. Talking with the "people" at cpw by phone is another fundamental error. Give details of the cancellation letter previously sent (the question above was right - IF you have proof of delivery you can change THIS letter to a LBA - explained numerous times on this site) and they don't have a leg to stand on. It should have gone the Southampton address (also given on this site many times) but a LBA should go to the registered office in London.
CPW is notorious for every dirty and unfair trick/practice (and LIE) under the sun to STOP people cancelling their contracts with CPW O2 in a timely (or easy) fashion. Others be warned (yet again!!).0
