02 faulty phone help

hi guys ive had a little issue with 02 and would like some feedback

i have a 5month old contract on a phone i use mon-fri for work if its not in my desk its in my jacket pocket im over 30 and look after all my phones and electrical goodies

i turned my phone off on fri night and turned it back on late sunday evening to be greeted with a blank white screen no logo etc my phone is or was a blackberry bold 9700

i called 02 and had some real issues with them returning the phone to be repaired after only 5months i thought thats the least they would do seeing as i send around 100 per month over 3 contracts 2 of which i have cancelled due to this little issue i have ben a customer for over 6 years

the phone came back on monday with a note can not be repaired due to water damage and when i phoned 02 to get some sort of reply i was told i had damaged the phone which shocked me to say the least im now stuck in 16months of a contract with no phone can they do this

surly if the phone could be water damaged within 5 months there must be a manufacture fault

1 i dont take it swiming
2 dont use it in the shower
3 i dont think its been scuba diving without me

can anyone help with this is there anyone i can speak to

    Some points in no particular order.
    Your contract is for the service not the handset.
    Your handset is covered by the normal Sale of Goods Act. So you did the right thing having the retailer repair it.
    Water damage doesn't mean the handset has been submerged. It means that moisture has changed the indicators in the handset or corroded a part.
    This could be by being in a damp pocket, use in the rain, condensation etc.
    You can either accept the engineers report or dispute it.
    If you accept it, then you may well be able to claim on your insurance for a replacement handset.
    If you don't accept it, then follow the Complaint Review Service procedure in your terms and conditions.
