*updated* bank have made an offer, woohoo, but should i accept?

    I would say a polite no also, tell them thanks for the offer but you will be proceeding with court for the full amount, i sucessfully threatened this and didn't have to file a claim. i got back in total about £500 on five credit cards.

    It took about another two weeks from there first offer.

    Go for the difference!

    when I had a letter like this from a bank I just ignored it, I then got a letter every two days increasing the offer, until in the end I settled. Mine was for £2800 ish and the offers started at £800.

    Having followed many threads on this subject (am currently waiting for my statements from HSBC) it seems that most banks will make this, or similar offers. However, it also seems that if you refuse, they will allow you to take it right to the limit, ie court hearing date but back down at the very last minute.
    I don't know their reasoning, since the Banks would not be worried about a few quid in court costs, but I would imagine that if a case did go to court, and went against the Bank, this would be seized upon by the media and Banks could possibly be ordered to refund charges to ALL customers.
    Probably for this reason that some of the successful claimants have been asked to sign 'confidentiality agreements' before receiving their charges back.
    I would think that you stand a very good chance of a full refund if you carry on.

  • My SIL has claimed back £2300 and Woolwich/Barclays have offered £1000. We have refused and need to get the forms from the courts to proceed.

    Can anyone tell me which forms I need to get for her and how much it will cost:confused:

    DONT !!!! accept it what about the 8% interest if they havnt paid in full by the time you put in your claim then you can add on interest... when doing mine i just treated them like they treated me .......would they accept the offer.....NO....

    The problem with a "goodwill" gesture is it is not accompanied by an admission of guilt. This means that they can (and probably will) continue to apply charges. If you get the full amount this may stop this.

    Accept it as a partial settlement only with the clear understanding that you'll be pursuing the rest through the courts - there's a template letter for this purpose on the Consumer Action Group website.

    Please don't lose sight of the fact that this is *your* money that you're reclaiming - why show generosity towards the institution that unlawfully took it in the first place?

    right, thanks for all the advice folks. i'm going to send them a second letter before action informing them that i will not accept the lower offer and they have two weeks to reconsider before i will be starting court proceedings. that sound fair by you guys?

    Not sure about what forms so do it by hand but you can do it online here

    got a letter from the bank today telling me, basically, to get stuffed. they made an offer i refused end of story...

    they are so messing with the wrong girl! :mad:

    can someone help me with the court side of things now, where do i go, what do i do?:confused:

    help! i so want to kick their asses so hard their wallet falls out depositing £623 into my hands :rotfl:
