*updated* bank have made an offer, woohoo, but should i accept?

hey folks, well got a nice (late) birthday pressie from bos, they have offered me (as a 'goodwill' gesture) £444.50 back of the bank charges i'm claiming, total of £623.

the offer is less than £200 short of my total and as my next step would be to start court proceedings should i accept? i'm torn, i know martin says not to accept an offer, press for the full amount, but when the full amount is so 'small' is it worth keeping on, i was worried they'd drag it out to see which way the courts answer on it before replying or is this almost an admission of guilt?

the money they are offering would take (one of) my cc down to 1k, about the same as the other and therefore make a big difference but the extra would also clear off the rest of my od too...

i'm so crap at making decisions, any advice or suggestions you guys can make is greatly appreciated! xx

Well done. I have to admit I would feel obliged to accept the money but it's your choice.
To be honest i'm not that knowledgeable on bank charges but i'm sure some1 in here will have some good advice.

They're only offering you two thirds of the amount you're claiming. I'd knock it back.

I claimed from Barclays on behalf of my brother. Total was about £800 and they offered £630 (or thereabouts) after some negotiation ;) which I accepted.

To me the extra £170 odd wasn't worth the all waiting and form filling plus the additional court fees and any more arguments.

I know that many won't agree, but I considered it a fair offer and the money was in his account within a week. Barclays were happy too as they didn't have to spend any more time on the claim.

It all depends on how far you want to push it. If you carry on you'll get your money back, but you could be in for a long wait.

  • I got confirmation this week that Barclays have been served with my claim against them. Then this morning there was a letter offering £85 when my claim is for £835.

If they wanted to convince me to take this one to the wire that's the way to do it.

A friend of mine accepted a 2/3rds offer - but she'd no idea she could even claim charges back until some little devil got on her left shoulder and started whispering in her ear (OK - it was me). So, for her, it was a bonus even though I was pushing her to go for the full amount

Lynseyjane - I'd say a polite but firm "no" and continue. If it's a small amount to you, it's miniscule to them and they won't go to court over it. Think about it - they'll end up in the papers and that will encourage everyone else to go for it too. Banks are cunning, but not stupid.

    Go for the 100%.

I think the other way I would look at it is in the time you will wait to take it further, how much more in interest will you pay on the debts you could pay with it aswell as all the hassle, court fees etc. 2/3 isn't ideal as an offer but all about if it is right for you.
One day I might be more organised...........

i doubt the interest she will pay will add up to 200 quid if she waits another few weeks, but regardless id wait for the full amount, which she will get.

Did you include interest and court fees in your claim?
