Help for my Nan

    Many thanks DVardysShadow for your concern and advice, I got my Nan to phone the company today and I was with her when she did the phoning. She got put though to a first aid person, not the person that the accident was reported to. My nan told him about the accident and also her concern about it being put into the accident book whiole she was there and not been able to sign the accident book.

    The first aid person, told my Nan that she would not have been able to sign the accident book as that was the first aid people responsibility to sign the book. He also told my nan that everything would be log on to a computer. Is this correct or was he jsut saying that to get her off his case. Waiting for the first aid person to get back confirming that the accident was put on the computer, if she does not get a response then I will go with her to the firm and demand to see it on the the computer and what was put on it.:([FONT=&quot]

    It may have moved to a computer based system, but I doubt it. This is either ignorance on the part of the First Aider [confusing the statutory Accident book with an in house[?] first aid record] or a case of fobbing off. She should dig her heels in to see the accident book and if it is not made available within 2 phone calls on Monday, she should take this up with the HSE.

    The company have a legal obligation to report absences of over (I think ) 3 days which are as a result of an accident at work to the HSE. If she is still suffering the effects she should not return to work and contact HSE

    Thinking back to the conversation that my nan had with her firm today and the first aid person saying that they were responsible for signing the accident book.
    It's obviously now that they did not enter the details of my nan's accident on to their system but I will have to give them the benefit of the doubt until Monday. If they do not produce a printout of the accident with the correct details on it from their computer then I will have something to say about it.
    I will advise my nan to report it on Monday to H&S, if this would get her company to made a proper details of what had happened.
    MyRubyRed. my nan has been suffering the effects of the accident for more than 3 days now therefore should she just report it to the H&S people on Monday to report it. I am sure her firm will not want to admit to have been so careless about theri staff H&S as they places a lot of emphasis on a safe working environment.
    I am so mad now at the way they are treating my nan as she is not a person to make a fuss and would suffer in silence, which she did after the accident.

    That is correct.

    Under RIDDOR, if the OP's nan has been absent from work for over 3 days, then this type of incident should be reported to the HSE contact centre WITHIN 10 DAYS of the incident or earlier in more severe situations.

    The company should have a designated person to complete and submit form 2508 .

    This needs to be sorted out as from experience, a relatively minor injury could develop into something more serious over time - particularly as the OP's nan is of more mature years.

    Ask for a copy of the accident report entry or a print out if it does indeed transpire that it is stored electronically.

    BTW there is no specific requirement for a company to have an accident book, however all accidents must be recorded and details retained and an accident book is a simple method to satisfy this requirement, however, compliance with the DPA for such documents also needs to be considered if using your own.
