Is it legal to collect money with the clear perspective that no service will be provided? I doubt it.

I agree, there is a consumer program on the local radio, what the companies do sometimes is just refund the policy (which naturally won't cover the replacement cost of a handset).

So, if they can't be sure, why do they accept money well knowing that they are unwilling to fulfil their obligations under the terms of the policy?

Anyone with a law background in the group?

But it's your responsibility to provide them with the details of the phone that's being insured!!! You didn't fulfil your part of the bargain when you didn't give them the details of the phone, so they don't have to pay out. It will be in the T&C.

Your example of the vehicle insurance is slightly different as it's a completely separate policy from anything else. If you didn't fill in all the details, your policy wouldn't have been processed and so no money would have been taken.

However, with the current account, the fee for the insurance is payable whether you want the benefit or not. If someone didn't have a mobile phone, they would still have to pay the same fee. The fact you didn't effectively tell them you had a mobile phone means that it wasn't insured. Therefore, it's nobody's fault but your own.

    Wait A MINUTE?

You "forgot" to tell lifestyle group what phone needs insuring and you are now blaming them?

LMAO. You are being beyond ridiculous.

BTW, LSG are pretty damn good. They sent me a brand new phone when I cracked the screen on my HD2.

Altho, I have to admit that I did register my IMEI with them. ....SIGH....

And the bank account with benefits that you are woffling about gives you the option for free phone insurance if you want to use it. They DON'T charge you specifically for phone insurance. There is a difference.

You obviously have to register your IMEI with LSG. And next time, learn to read.

    Dear All,

After having made my point and threatened to escalate the matter, I won my case and had my phone replaced. The case is closed and I hope others will be able to benefit from my experience.

    All the best.

    I suspect a 'goodwill gesture'.
  • My case is a bit similar to yours, rbday, lost my mobile abroad, the thing is that I didn't get the Insurance Certificate after registering my details, but I submitted them all (IMEI number, etc). I'll get back in a couple of days and I really don't know if the claim would be successful, or what to expect since I don't have the mobile phone insurance registration certificate. Any help? Thank you.
