CSA Debt for child that may not be his.

    Hi gravitytolls, there was no reason even if she was angry to make my brother believe that the child was his. No man deserves to be led on like that no matter how angry any women is.

    pregnancy is usually referred to in weeks, starting from the first day of the last menstrual period so when a doctor says you are 6 weeks pregnant the foetus is only 4 weeks and that could well account for the difference in the dates

  • Thanks kegg, we have gone round and round with dates so many times but never had they added up or made sense. I would love to see anyone else do their calculations.

    She arrived in U.K on 2 April 96 and said that her period began on 1 April 06 and she had her baby on the 23 Dec 96. My brother slept with her approx on the 14 Apr 96. On the 29 Aug 96 she was 19 weeks and 5 days pregnant.

    All of this is in the records and I cannot see how the paternity results matched. Something is very wrong.

    The wife is acting in a total consistent manner if the child is hers and your brothers.

    Imagine if you had a child and despite all the evidence presented, your ex partner (who you know is the father) kept insisting the child wasn't his? How would you feel? I know I'd be pretty angry.

    Of course if she is a liar then a good one would act in the same way.

    There seems a good chance this child is your brother's despite his doubts and no child deserves to be treated in this way no matter how angry the father is.

    If he has contact, can he organise a DNA test himself for his own private satisfaction? If this then comes back as negative then he can pursue it further with the CSA. If it comes back as positive and he still has doubts then I would seriously ask him if there is anything that would change his mind on the child's paternity. If the answer is no then it's your brother's problem, not the child's.

    Using this link - they have the first day of period as 1 April 2006 with an expected delivery date of Jan 8th 2007 - this is only 15 days earlier than the actual delivery date for your brother's alleged child - 2 weeks either side of the delivery date is considered normal so I don't see how 15 days could be considered impossible or even extraordinary.

  • Thanks Soubrette I agree with everything that you have said and I have suggested that my brother take out another paternity test so that we can put this matter to rest once and for all but I am certain that his x would not agree.

    I strongly believe that another test should be carried out and my brother would need some legal advice on how to do this. If my man said to me that he did not believe that he was the father of my child I would not hesitate a second in proving him wrong and have the pleasure of rubbing his face in it. My brother's x on the other hand gave him the run around for so many years even after he had the money many times to arrange the test.

    Sometimes I really don't understand why people can be so stupid and let things drag on like this.

    Well if her period was the 1/4 and he slept with her on the 14th then it would be at her fertile time.

    If you are coming from a social group that marries cousins, then it is also probably one which regards women who have sex outside marriage with distain at best, so you brother's refusal to acknowledge the child will be a massive personal slight on his ex wife, jeopardising her and her family's social position.

    Onthe otherhand if cousins have been marrying cousins for generations, there could be a considerable amount of in-breeding that would not be seen in a UK population.

  • Thanks kegg I only want to know for certain as well as my brother because doubt is on our mind and has been for many years and we really need to know one way or the other what the truth is.

    DX2, as for marrying cousins I was always the black sheep of the family as I was always against this idea and still am but do not condone anyone who does it as it is their life.

    We do not come from a family who believe that if the x has jeopardized the family social position either, we do not think or believe that. The problem is that my brother cannot get this doubt out of his head no matter how hard he tries and if it was possible to have a second opinion then that would lay matters to rest permanantley. I don't see any harm in having a second opinion.
