incapacity stopped

was due to be paid yesterday but they stoped my money as they said i failed my medical.have posted a appeal form. but have no money for me and my son.i suffer with depresstion and dont no how much more i can take.find in really hard to talk on yhe phone and the thought of having to go out is killing me. can anyone help me please

    Are you on incapacity benefit?
    If you are appealing the decision as far as i am aware you can claim income support.This is provided that it is just you and your son in the household ie if you have a partner living with you and they earn their income would be taken into account as to whether you qualify.
    Have you got a copy of your medical report?
    If not write to the DWP for a copy.

  • i was on incapacity.had the letter saying that it stoped on 16th sept. rang loads of different numbers, and all i was told is the only thing i can do is go on jsa.got an appointment tomorrow,which in so scared of. but i dont understand if i cant go out how can they say i should clain jsa. dont know what to do for the best.i have got no money.and no family or friends that can help.its just me and my son.

    You should have the choice of claiming either JSA or Reduced Rate income support (income support minus 20 percent).

    Its quite common for the jobcentre to lie to claimaints and tell them they are only eligible for JSA.

    If you have no money, you can ring up to apply for a crisis loan (ring up the DWP and ask them for the number for the crisis loan line) - this can be used to cover living expenses (gas/electric/food) - but has to be repaid when your benefits are sorted (interest free loan)

  • got to go to jobcentre soon, really nervous,dont know what to exspect,dont like talking out my problems as it is.and how much detail do i have to go into.i dont know were to start.any advice

    ie. if you had a working partner/other income/savings you wouldnt be able to claim it?

    Yes. You would need to meet the savings / income limit for IS.

    I doubt they lie but are instead poorly trained.

    An individual staff member has nothing to gain by getting someone to claim JSA instead of IS.

    I had the same advice given to me!!!

    Failed ESA medical, claimed JSA, they cancelled the ESA claim, only to be told two days later that I was too ill to claim JSA, then went back onto ESA, then got no help with getting back into work, cancelled ESA and claimed JSA.
    Now got argument of what type of job I should be looking for.

    Does it ever end - NO!!!

    Follow that if you can! All in the space of 8 months!!

    They have done it to me. They have done it to many others (many reports on the web) even the CAB has officially presented evidence before that it happens (ie the DWP have even told CAB staff the same).

    The guideline would not be to give incorrect advise, it would be to give the correct advise.
