Am i really? Will i really, really be free from debt?
I read the posts on here, from people who say they've gone bankrupt, but end up haveing to make payments for several years? and i don't understand it all. Why do you have to make payments, when you've gone bankrupt? Even the advice agency has sent me a letter about making payments. I'm just so confused. Anyway, i've got an appointment there today. Maybe at least i can find out about the process of handing my keys back. Oh, its too upsetting to talk about.I just feel so despondent, everything is such a struggle, at the moment.Debt free - Is it a state of mind? a state of the Universe? or a state of the bank account?

You only have to make payments if you can afford it. It will work out between 50% and 70% of your disposable income, depending on the amount.
This is only for 3 years anyway.
When your declared bankrupt and all debts are written off, your wages can stretch further and therefore you contribute for 3 years, again if you can. I do and am glad to do so. Not glad, but you know what i mean.

Righty ho I'm no expert, but I can get you started kinda thing.
When you went BR one of the sections of the forms was a income and outgoings statement. This would have showed what would be left over after all your outgoings have been taken care of. Any money left over £99.00 would be subject to a IPA which would start at 50% of any left over so for example you have £100.00 left over the OR would want £50.00 of it.
This gets paid for 36 months subject to any rises or falls in your income due to wage rises, loss of job, rent being put up and so on.
So yes you are debt free from any unsecured debts and once the house is gone compleately so.
I would suggest though you stick a SOA up and one of the more clever ones can jiggle with it.0 -

They asked me today, who is your solicitor? Solicitor ? You're joking,are'nt you. Who can afford one when bankrupt? You mean you've done all this yourself? Well no. You guys have done so much for me xx So, yes, i suppose i have.They said i'm remarkably calm. You're joking. You can't see whats going on inside my head..............................................
So, maybe i should study for a law degree? Except i'm bankrupt............
Maybe i shoul'nt be so hard on myself. I've got this far.
Anyway, i now understand a bit more about the whole process of how its decided whether you make the payments, people are talking about. I now understand what the OR is looking for. I'll just have to sit it out still and see what he decides. Then appeal maybe ? if its worth it. The advisor said apparently its standard procedure to freeze your NI contributions, as its classed as money you could be paying your debt with. If thats the case, why am i still paying tax? because to me, these two things come as a package. You legaly have to pay them if you're working, though maybe i'm wrong, with NI. But for the relatively small amount of NI you pay, it still does'nt make sense to me. I will have to have a NI fund now, ( because i've missed about 4 months ).Bother.
The advisor tried to ring the IS, but it seems their phoneline is no longer working. Checked several time this was the correct number. Yes it was. Dead. Maybe the IS has gone bankrupt? ????????????????????????
Haha. I could'nt resist that one, sorry. Back to the thing thats niggling me now. We could'nt find what to do with the keys for the property. No one is interested. In fact, he told them over the phone, its in your interests, otherwise you'll have to break the door down.
Looks like break the door down, is what it will have to be. After several hours of being stressed and upset about what i should do with the keys, ( i went into the branch, and asked for whatever its called, a jiffy bag, to return them to them ). We have'nt got any here. No interest whatsoever. had to have a conversation in the branch, in front of all the customers. Do you have another telephine number we can contact you on. Most definitely not. A bit different to your attitude of the last year. Do you want the property, or not?
Anyway, i've done my best. Thinking about it. Its not my perogative to be chasing them and getting upset about what i do with the keys. The advisor is astonished they have'nt been in touch. So the ball is in your court now, lender. I really don't care if you have to replace the doors. Its not my problem.Once i'm out of here, i'm out of here, and i'm not sitting waiting for the baliffs to arrive...........
The advisor also gave me food for thought. Take some time off ,before you go back to work, YOU time, time to refocus.I'd already been thinking about it, myself, because i'm getting pressure to go straight back to work every day. Straight back on to the roundabout. Not a good idea.It may be good for them, but its not beneficial to me. I've got my assessment for my xmas job next week. Maybe i'll just do that, instead of doing two jobs, as i was planning.Take some time out until its starts, and i know i'll get paid weekly for it. Than maybe go back to my ' proper ' job, in the new year.
The funny thing is, the advisor, said the OR will realise i've said all along, i knew i'd lost my house. But that all along, has taken me a year, 18 months? to reach the stage i'm finally at now.A long, long emotional process. I've been thinking of putting a SOA in my diary page, when i get sorted, and i know what my bills etc will be. But although i can list my outgoings, its virtually impossible to predict incomings, as i'm s/e. I think i've managed to establish on every form i've filled in so far, there is very little, or no disposable income left.
I've definitely got to be more organised with this, in the future.

Just remembered another useful piece of advice i was given today. Apparently my debtors will try anything to get me to sign an acknowledgement of debt form, wherein lies a very ' grey area ' as to whether you then become liable for your debts again. I'd forgotten that, although all along they have been saying to me, don't sign anything. Don't sign anything, don't sign anything, don't sign anything.......
To anyone reading this, this is the most valuable piece of advice, you can take. I guess thats why the opposing side was so desperate to get to me, at court. Yes its my fault, i owe money. But i have'nt gone through all of this to go back to stage one.
My thanks too, to ****** ***, because without all you amazing people there, i would'nt be where i am now. Maybe i've been lucky with my branch, but they've dropped everything, every crisis i've had, Theres always been someone on the other end of the phone, or you've seen me the same day, or the day after. The insolvency service has 'shut down' until the 19th I've been informed, for some upgrades/updates or something or other... so this may be why you've been unable to get through.Total 'Failed Business' Debt £29,043

They will/may place you on a NT (nil) tax code and therefore you will not pay any tax. This amount will instead be paid towards your BR. (until April)
This takes quite a few months after BR to finalise.I'm no expert, but i'll give you my opinion, my support and my experience. Its all i have.
