I think it is an issue that a company has got my details (without me telling them they could) and are sending me texts telling me to text a premium rate number to opt OUT of something i never opted in to.

They're not. Its not a premium rate service, actually it is just standard network rate.
Marketing Texts are becoming more and more widely used. If you have opted into receiving marketing information, theres not an awful lot that can be done. However, if any become chargeable, without it being clear thats the case, fines of 1/4 million poundds can be given0 -

If they are texting and phoning my mobile number then yes they have SOME of my details, surely? They just don't have my name.
If you are not interested in this thread and we are irritating you so much, may I suggest that you don't look at it?

I am sorry that you found my response rude, it was not intended that way.
I was merely saying that saying "Get over it !!!!!!" and "Good grief" suggest that someone is getting irritated by this thread, and that it is not necessary for them to read it if they are annoyed by it.

SMS 'spam' is the next thing, however if the messages are free, theres no regulations around this.
HOWEVER, most brands and firms that are 'savvy' know that someones mobile phone is a very personal device. Therefore, unless you have opted in to receiving the info, MOST will not misuse this.
Unfortunately, if you, or even the previous owner of the MSISDN (Mobile phone number) has opted in SOMEWHERE, the number can be sold and used. Networks such as O2 etc, are meant to 'clean' a number before it gets re allocated, so a previous owner who has subscribed into a subscription service, for example, the subscription stops before the new owner is assigned. Sometimes this slips through though, but is usually sorted quite easily. However for free services, again, its not easy.
The OP was given the option to opt out. This is probably the easiest thing to do. 'Josie' may have opted in to the service, hence why you have received the text.0
