oh what to do next

Brought a projector on ebay £350 paid by paypal, the guy we brought from had had it 6 weeks, and he had brought it new from an ebayer who only sells this item & offered 12 months warranty,
anyway the projector has never worked and after many emails/phone calls we don't seem to be getting anywhere, we were gonna send it back to him so that he could return it to the seller who offered the warranty(cos not sure if warranty is transferable) anyway have emailed him to say i will be posting back to him by recorded post, he has replied to say he doesn't do refunds or returns and will not accept deliver of the returned item.
what can i do?

    In the first instance start a chargeback via paypal for a broken/damaged item.

    is it ok to do that as i thought i would have to try sorting it out with the seller, my worry is that he sold me the projector then brought a car so i guess his paypal account will be empty.

    You have 45 days to start a chargeback, so if he has any sales in th enext few days then time your chargeback for then so that those funds will be held. If (and there is never a guarantee) paypal find in your favour you will need to send the item back at your own cost, but it must go back tracked and fully insured.

  • looking at his history he has only sold a couple of things, thing is where do i stand if he refuses the delivery, i guess the item would be returned to me and back to square one. i was hoping that he would do the right thing and get the original seller to replace the item under warranty.

    Cross that bridge when you come to it.

    I was unable to return a misdescribed item as the seller refused to give me an address. Paypal refunded me without insisting I posted it back. (This is probably not a common occurrance, but it shows that paypal can sometimes be reasonable.)
    My TV is broken! :cry:
    Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j
  • If you have proof that it was posted to him Paypal 'should' accept that in your favour, it's upto him if he doesn't want to accept it.

    i am a bit reluctant to go for the chargeback cos i know he won't have the money in his account, then i would end up with no goods & no money, he is saying i have to wait and let him sort it out with the other bloke but having waited a week for this nothing seems to have happened.
