I thought when you went Bankrupt it wasn't supposed to be easy? you've already had loads of debt written off, why should you keep all your overtime as well?0

Im not sure what the problem here is, the OR has asked you to fill in the forms with your currebt circumstances so you hould do so with whatever your income and expenses areHi, im Debtinfo, i am an ex insolvency examiner and over the years have personally dealt with thousands of bankruptcy cases.
Please note that any views i put forth are not those of my former employer The Insolvency Service and do not constitute professional advice, you should always seek professional advice before entering insolvency proceedings.0

its just personal view like tv said if he didnt do the overtime creditors would get nothing, but why do loads of hours for £500 in overtime to receive about 150 at best, thats less than the minimum wage isnt it which is illegal, and he is already paying into an ipa so the creditors are getting some monies back, there is no incentive to do the overtime,my view is the rules are too strict here, im not knocking the insolvency service they have rules to follow but it just deters people from sometimes going to work because there not willing to work to have money taken off them and to be honest i dont blame them0

You are of course entitled to your view but this sentence did make me laugh. When you put these things into perspective and look at how other countries handle bankruptcy you will see that we have some of the most lenient bankruptcy rules in europe and the western worldHi, im Debtinfo, i am an ex insolvency examiner and over the years have personally dealt with thousands of bankruptcy cases.

It's not illegal on national minimum wage grounds - the employers will be paying NMW or above. It's how the money is then spent/distributed which cause the reduction which is nothing to do with the employer.
Also, with most IPA's the money will go on OR fees rather than to creditors.
The allowances in BR are far more generous than in a DMP or IVA, so I don't see that the rules relating to IPA's are too strict.
However, I can see both sides of the issue, and I think is needs to come down to what the individual decides to do.0

 2. why should i work 24hr calls if OR takes most of or all of it.
i dont mind paying ipa but i dont want to be struggling to make ends meet for 3 years i would be better off not working at all
 broxie

Like i said at the start its your choice if you do overtime, As well as the financial implications the other thing i would consider if it was my job in gauging if it was worth it is this, if i turn down the overtime now, will i be asked next time when i am clear of the IPA, At the end of the day its down to personal choice, the OR wont make you work but if you do you need to declare itHi, im Debtinfo, i am an ex insolvency examiner and over the years have personally dealt with thousands of bankruptcy cases.

True, but they should be legal choices and not choices that break the terms of your BR.:pB&SC No. 298
