How are the OR unjust? we all know the implications of BR and what the terms and conditions of BR are, all the OR is doing is working within the t & c of the bankruptcy. Anyone breaking these terms are looking for trouble.:pB&SC No. 298

BUT what you suggest in post #4 is WRONG and dangerous....will you still be around if someone does what you suggest ends up with a BRO/BRU and a criminal conviction?
and i'll stick with what I said you were VERY lucky to do what you did and face no repercussions..
and please loose the attitude milo...its really not neededWe all die. The goal isn't to live forever, the goal is to create something that will0

attitude,im expressing my view personelly i think an ipa should be based on salary and your choice for overtime i think 70% is a lot to take it leaves the person well below minimum wage take home sometimes, which is wrong thats my view like i said im entitled to it wheather its wrong or right so please lose your attitude phil its really not needed is it:D0

i told my depot manager today that i will probably stop doing call outs soon as whats the point 1. i only get money if i get called out not gauranteed so how can OR work out how much to take.
 2. why should i work 24hr calls if OR takes most of or all of it.
i dont mind paying ipa but i dont want to be struggling to make ends meet for 3 years i would be better off not working at all

            I can see both views.
obviously I got my self into debt and doing bankruptcy therefore the OR has to act in the interest of the creditors to try and get as much money back as possible.
But also the overtime is voluantary so unless I work it the OR wont get any extra. Like i said in my first email, I could understand the OR taking 70% surplus if i had over £500 surplus from my basic wage .
 Anyhow an update.
Emailed OR stating that the income expenditure form I sent a couple of months ago wouldnt have changed that much - stated that the £20 i pay HMC for overpayment in child benefit would end this month and how I assume that my IPA would increase to at least £70 to reflect this change.
 OR replied with the following
I understand that your child benefit overpayment is due to cease but that is not to say that your IPA monthly payment will increase to £70 as the assessment caps by which we follow when we conduct an reassessment have now changed.

I can not provide any sort calculations until I am in receipt of a completed questionnaire for me to conduct a reassessment.

As you have already stated that you have started your overtime then effectively you have had a change in your financial situation along with ceased payments for child benefit and the expense of dental care for your wife. Under these circumstances a reassessment would have been conducted.

Please complete your questionnaire in due course as I will be unable to answer any questions in regards to your monthly payments until I am in receipt of it.
Does anybody know what the new caps are?0

There's a new household average survey from January, so if you want BR in November they would have used the previous version of the guidelines.
Otherwise, not sure what "assessment caps" are.0
