UPDATE - 25th Oct received a letter regarding my Santandar credit card which was originally sent to the below on the 6th Oct:
SANTANDER
201 GRAFTON GATE EAST
MILTON KEYNES
BUCKINGHAMSHIRE
MK9 1AN
The letter says:21 October 2010
Dear Sirs,
Re: Account No:xxxxxxxxxxxx
With reference to your letter recived 19 October 2010 and your cheque for £1.00.
We are unable to proceed with your enquiry as the cheque you have sent is made payable to Santander. Can you please re-send your request and make your cheque payable to MBNA.
Yours Sincerely
MNBA EBL
I have the signed receipt from royal saying that is was signed for on the 7th Oct.
I have not heard anything regarding the A&L Card yet but as I said in my last post the cheque has been cashed.
Next step of action:
Send the second follow up letter to MBNA with a cheque to MBNA via recorded?
Send the second follow up letter to A&L?
Any thoughts on this?
Thanks

Send the letter account in dispute no CCA received to A and L.
With regards to the santander/Abbey if you sure that the credit agreement was taken out with santander/Abbey not MBNA then do not send the cheque to MBNA because they are not the original creditor.
Send a another letter to Santander/Abbey saying that the credit agreement was allegedly taken with them not MBNA therefore they should process your CCA request.0 -
Hi
I am getting things together with this and I have had a reply to my CCA request for the A&L card that is now MBNA, this was the start of the reply:
"We refer to your request to us under section 78 of the Consumer Credit Act 1974 ("the Act"). Unfortunately, we are currently unable to comply with your request.
For so long as this continues, we will not issue court proceedings against you to recover any amount owed either now or in the future, please be aware that you should continue to make payments......."
And the Abbey card did have a CCA, so thanks Paris your info was correct!0 -

You can write to them Recorded Delivery a letter pointing out account in dispute and stop paying them and/or carry on paying them, but do not use the account, depends on what you are trying to achieve, really up to you, sure others will advise soon , also if you can you copuld ask them for a Full & Final figure to clear account if you are able.0 -
Hi Mike
I am going to send out F&F to my other card holders so I guess I will send one to these also and they should maybe take a lesser amount?0 -

Hi Mike
Yes I guess the card with the NO cca letter will require to be re-worded? Below is the one I am sending to the other cards but I will look at re-wording it.Name of Creditor
Address of Creditor
WITHOUT PREJUDICE
Dear Sir/Madam
Re: Account No/Reference No:
I write with reference to the above account.
I can confirm that I am unable to offer to pay the money which I owe as my financial situation has changed dramatically. Currently I am running my own business as self-employed but my current work load has dropped dramatically this year which I have only been paying the minimum payments for many months now in the hope that I could secure more work and reduce the outstanding balances. Unfortunately I am now in a state of serious financial hardship, where I am having to default on payments.
I attach a copy of my financial statement. This shows my average income and monthly expenditure and the offers I can make to my creditors. The offers have been worked out based on what I owe so that each creditor gets a fair share of money.
The amount I can pay you is £[ ] a month. I will be able to make my first payment on [ ] 2011. [Please send me a direct debit form.]
Please agree to freeze interest and other charges on my account as long as I keep to the monthly payments. I will let you know about any changes in my circumstances.
Alternatively, with the help of a relative, I can raise [£xx,xxx and I want to offer this as an ex-gratia payment in full and final settlement of the account. This offer is made on the clear understanding that, if accepted, neither you or any associate company will take any other action to enforce or pursue this debt in any way whatsoever and that I will be released from any liability.
Payment can be made within 2 weeks of receiving your written agreement of this offer and method of payment.
I look forward to receiving your reply.
Yours faithfully0
