    An informal agreement still suggests an element of consideration?

    If the op has to pay rent to occupy and as a result of not being able to pay it, has been asked to leave, that sounds like a tenancy to me?

    A TA can be verbal and evidenced by way of letter etc but as OP has said that isn't the case, I will back out gracefully!!

    Again I am guessing, but chances are that the agreement is informal for a reason, in that the 'landlord' does not want to have people officially living there.

    OP, can you elaborate on your situation with your friend/ landlord?

  • Well its basically an old hotel which has been restored. He let me stay there while he was restoring it and I was helping him so I didn't have to pay rent. But now its been finished and been put up for sale, I just happened to loose my job and he wants rent now and wants me out.

    Does he want you out irrespective of whether you can pay rent? Would he let you stay on a more formal basis if you were able to pay?

  • No he wants me out no matter what as hes trying to sell the place and has also told another lodger they need to go and they've left already as they had somewhere to go.

    That's a pity, he could have been on to a nice little earner if he let all the rooms!
