    I assumed that you were going to accuse me of being a friend of Tims as that's what you did to one of the last people(sunshintours I think it was) to disagree with you but being accused of being Tim is just as good I suppose.

    In actual fact I'm someone who bought one of these beds you're talking about (Romantica Madrid) from him about 3-4 weeks ago.

    I assume he gives advice on products that he sells for just that very reason, he sells them. Works with them everyday, speak to different customers about there needs and requirements, knows about them ect ect ect.......

    The impartial advice bit I guess is the spec of bed, which you could potentially buy from any brand. The unique bit being turnable which he advices is better than non turnable which I guess makes sense.

    Don't get me wrong I found Tim through these forums, which I'm guessing you did as well from your previous posts, but he can't be blamed for that. After looking at the different advice he was giving people I actively searched for his site on google. I don't have a long list of requirements when it comes to bed sellers, good feedback on seller(which to be fair there are lots of on here and I ordered before reading your post), good customer feedback on the product, good price(as I said earlier saved £500 on equivalent mattress in dreams), someone that sounds like they know what they're talking about and will let me swap it if I don't like it.

    It's not a long list but all relevant I think.

    There are a few. So why don't you do your own homework as you don't like the advice I give, and go and find out for yourself?

    And for your information, it's not the manufacturers who have the returns policy, it's the retailer. And there is nothing to stop any retailer doing the same.

    As for Allstar4eva. He wanted a mattress that doesn't exist, so I tried my best to find a design that would be a compromise. I actually thought that he was going to be a very difficult customer right from the start, but as always I tried my best to help, and came up with the closest possible to what he was asking for. The trouble is that because he seems to think he is an expert in mattresses from a little research that he has done (he actually thinks that if a mattress has very dense memory foam, then it is the best quality), then he actually refused to try the mattress out. This meant that there was no way of finding out what was or wasn't suitable with the mattress, so we couldn't even look for a suitable replacement. He has actually had a refund, and is actually trying to blackmail me over the £30 return postsge (which we were fully entitled to charge as he refused to comply with our terms and conditions, so we therefore went by DSR's which do allow us to charge return transport.

    So he now has a personal vendetta against me, and is on a crusade posting many lies and half truths on MSE in order to try and discredit me.

    There is no personal vendetta - we disagree on DSRs - I don't believe you had the right to charge me for collection and many on this site support this view.

    My experience was a bad one so I am simply warning others that:

    a) Your advice is not impartial imo as it leads to a good chance of your company getting a purchase.
    b) Mattresses are not a good thing to purchase online unless it has been tried out first.
    c) All customers should try mattresses before they buy to avoid unecessary hassle - a mattress is not a convenient item to store in case of problems.
    d) Not all La Romantica Mattresses are great (This is a free discussion board and we can have both positive and negative reviews).

    I am not saying that in general you do not provide a good service or that your products are not good - just that your advice is not impartial and it appears that as an online retailer you are ultimately here to make money. This is all in my opinion.

    Our situation as you have mentioned it was that:
    1) I contacted you asking for a firm pocket sprung mattress - you told me such a product does not exist despite the fact that Warren Evans make an extra firm pocket sprung mattress.
    2) I enquired about a top of the range pocket sprung mattress and you recommended a bottom of the range open coil based mattress.
    3) I was not happy with the mattress
    4) I said I would be happy to purchase a more expensive mattress from you if you had something similiar to the Warren Evans Sienna mattress.
    5) You wanted me to sleep on the mattress for seven nights even though I was not happy with it in order to help you find a suitable alernative (even though I told you what I wanted) and despite failing to explain to me what would be achieved by this as I had already tested it out (I tested it but did not sleep a night on it).
    6) Because I would not sleep on the mattress for seven nights you initially refused to collect it from me and suggested I should return it at my own expense. How expensive and inconvenient is it for a customer to return a mattress?
    7) I said I would return it myself if it meant that I got a cash refund on delivering the mattress but you claimed it has to be inspected first. On finding I would not get a cash refund on return of the mattress I thought what's the point and set out to find out my legal position on this thread.
    8) I found that under DSRs you have to refund my money withing 30 days of cancellation whether you have collected the mattress or not.
    9) You collected the mattress after a lot of hassle but still charged me £30. You refused to alter the collection time despite the fact I had a doctors appointment.
    10) When you agreed to collect the mattress I offered an olive branch - so as the situation could end happily I offered to try the mattress just so you could sell me another even though I already knew I did not want the mattress initially supplied. I only did this as the whole matter seemed to get inflated out of proportion but you took the whole thing personally and refused this offer.
    11) We disagreed on our interpretation of DSRs as I felt you should collect at your cost under DSRs. Most people on the thread I created on MSE agreed with my interpretation of DSRs in that you should not have charged me for the return of the mattress. They also thought your site Terms and conditions were ambiguous at best.
    12) You claimed that there have been many recent cases to support mattresses being excluded under DSRs yet when challenged you would not detail even one case.
  • Wrong. wrong, wrong and wrong. All these items are in fact returnable under DSR, even though retailers do not like it known; that is in fact one of those cases where the retailer try to circumvent the law by saying it's in their T&Cs, but as I previously stated, policy can not supersede law.

    There are a few exceptions to the DSR and they are specificallywritten in the Act, namely:

    - goods made to the your specification (custom-made)
    - perishable goods (flowers, fresh food)
    - CDs, DVDs, and tapes for software, audio or video if they are unsealed (have no packaging)
    - newspapers and magazines
    - betting, gaming and lotteries.

    Tim, I don't know you, never seen posts of yours before, but I am telling you now you're on a kicking to nothing with this kind of posts, because that's asking for a visit from TS and if (when!) they catch up with you, you'll realise that you are making expensive mistakes by not knowing the law and/or trying to hoodwink people. I want to believe that you are acting in error instead of on purpose, but if that's the case, you really need to learn and learn fast.
