No gas safety check certificate - Council enforcement needed

No EPC done - depends when you moved in - only cam in about 2 yrs back
No smoke alarms - unlikely to be required by law
Boiler does not work (we have no heating or hot water, we have an electrical shower and have to boil the kettle to wash dishes) - should be notified to LL in wriitng and approriate stpes taken - how long has boiler been out of action?
Mould, damp in bathroom(with mushrooms) - most likely casue is lack of adequate ventilation in the bathroom (need to open windows), although this is not the only cause.
Mould, damp in bedroom and dining room really bad in dining room wallpaper peeling away from walls - bedroom may be lack of ventilation or could be due to incoming water from a roof / gutter leak.
Landlord as told me to pay for all of the above then he will reimburse me
Deposit protected late (now been protected over 12 months later)
N5B form submitted but the following is wrong
No tenancy agreement(LL does not have one) - is the tenancy still within the original tenancy period or has it moved to periodic (in which case tenancy agreement is not particularly relevant)
S21 is not the same one as issued to me(the one i have as been served incorrectly)
False witness statement(witness statement states that S21 was posted on the 20th, when infact it was the 15th the date is on the notice)
LL protected my bond over 12 months later but,
did not provide DPS with my real details, false email and telephone number confirmation was then sent to email not my address.
LL then printed his own version changed 'Date deposit paid: to - Date deposit paid into scheme:' so he could then use that in court as proof deposit was protected within 14 days(i have now changed password,email and telephone with the DPS, the DPS as confirmed the LL as commited fraud) - It would have been better to let LL serve the false document at court and let him bear the consequences.
The LL appears to be a problem, and the advise to find somewhere else makes a great deal of sense. If you do intend to pursue, make sure you do not allow irrelevant / minor issues / potentially reversable issues (damp - may ultimately be your fault to some degree - have you informed LL in writing of thse problems?) to distract from the key issues.
It would have been better to simply update your first thread with new details as / when they came out - that way you'd get a more coherent set of advice.0 -
If i complained about an headache then started a new thread complaining about a toothache, would that then be contradicting myself, no of course it would'nt it would be a different issue0

If you went to the doctor with a headache and went back later that day with a stomachache he'd probobly say (or at least he'd certainly think) "why didn't you tell me all your symptoms this morning?"0

Note the HSE's comment
You should not assume that an annual service inspection meets the safety check requirement, or that a safety check will, on its own, be sufficient to provide effective maintenance.
A LL who has neither had the boiler checked for a gas safety cert nor "serviced" will be unable to demonstrate due diligence towards his/her T.0 -

Because i didnt need any info on above its only when i found out about the DPS i decided to take things further(obviously the boiler and damp i have allready taken steps about this).

i cannot agree with this... any application for possession must include a copy of the tenancy agreeement as this is the only way that, for example, a S21, can be deemed valid or invalid, whether the tenancy is in fixed period, or, in periodic....

but it seems to be that Op must decide what she wants to do... stay and possibly face a fight, or go and live somewhere better and more peaceful.....
if i were her i would focus my attention on moving house - and only then - spend time on bringing the LL to book - as indeed he should be brought to book....
If you stay - there will only be more frustration and possibly more confrontation....0 -
