Action against Landlord please read and advise

This is a long post i know, but after finding out today my LL tried to forge a letter from the DPS to claim my deposit was protected i am now taking things further.
I am a good tenant i have never caused any problems and i do not owe any rent, there is good landlords and bad but i think my current LL does not deserve to be one.

I need advise on what actions i can take regarding the following

No gas safety check certificate
Boiler not been serviced since 2006
No EPC done
No smoke alarms
Boiler does not work (we have no heating or hot water, we have an electrical shower and have to boil the kettle to wash dishes)
Mould, damp in bathroom(with mushrooms)
Mould, damp in bedroom and dining room really bad in dining room wallpaper peeling away from walls

Landlord as told me to pay for all of the above then he will reimburse me

Deposit not protected(now been protected over 12 months later)

N5B form submitted but the following is wrong
No tenancy agreement(LL does not have one)
S21 is not the same one as issued to me(the one i have as been served incorrectly)
False witness statement(witness statement states that S21 was posted on the 20th, when infact it was the 15th the date is on the notice)
LL protected my bond over 12 months later but,
did not provide DPS with my real details, false email and telephone number confirmation was then sent to email not my address.
LL then printed his own version changed 'Date deposit paid: to - Date deposit paid into scheme:' so he could then use that in court as proof deposit was protected within 14 days(i have now changed password,email and telephone with the DPS, the DPS as confirmed the LL as commited fraud)

  • Good Lord! You need to take legal advice asap. Contact a solicitor that has a tenancy/housing specialist. There are so many issues that you have mentioned that you need an expert to advise you. I think there are a few on here and hopefuly someone will offer the correct advice. It would also be worth speaking to the DPS...they should have a legal dept.

    In addition to the above, if he has actually submitted the false statement to court in order to issue proceedings, you can complain to the police that he has committed the offence of doing an act which tends and is intended to pervert the course of public justice. It's a criminal offence, although it incorporates civil proceedings.

    That being said, the safety and housing issues are definitely more pressing.

    Because of the list of issues I second Joanna's comment - legal professional is your best bet. Try Community Legal Advice or Shelter for for a suitable contact near you.

    You should also get an appointment with the Tenancy Relations Officer (TRO) at the local Council (private sector housing). This property sounds as if it needs urgent assessment under HHSRS ( housing health and safety rating system)


    No gas safety check certificate HSE or local EHO
    Boiler not been serviced since 2006 HSE or local EHO
    No EPC done Trading Standards Officer
    No smoke alarms TRO/EHO
    Have to have hardwired ones in post 1992 buildings and HHSRS assessment may comment

    Please stick to one thread - this is the 3rd thread on the same issue! Maybe it's because there are so many contradictions and by starting new threads it's easier for these to be overlooked by those responding.

    Simplest solution is to start looking for a new place to live. The LL/tenant relationship has clearly broken down. I acknowledge that it appears from your posts that the LL has not complied with legislation but at the end of the day he will get possession.

    Well, if the info is different, by definition, there are contradictions.

    You have help here from some serious and capable people. Now, of course info gets updated as it becomes available. We all know that. But if you are changing threads because that makes contradictions apparent, then don't. It just p's off your more serious help, because it makes it harder to follow what has happened and the development of your situation.

    By different i mean different issues to my previous ones, so there isnt any contradictions
