Primark returns policy on underwear

Hi Guys,

Long time lurker, first time poster!

I bought a 6 pack of Primark essentials Bikini briefs on Monday. Yesterday after a bath, I opened the packet, put on a clean pair of the undies and settled down to watch all the soaps. :D

After 2 hours, I got up for a loo break and noticed that the elastic around the waist had already ripped from the fabric rendering them unwearable. Now I am aware that the quality of Primark is generally not the best, but surely a pair of under crackers should last longer then 2 hours? Its not as if they were being ripped off in a fit of passion either I was sat quietly watching TV!!

The refund policy does state:
Because of the nature of some products, we do not offer refunds on underwear, jewellery or cosmetics. This list is not exhaustive and does not affect your statutory rights

Do I have 6 expensive dusters here or can I ask for an exchange as they are defo poor quality and in my opinion - faulty? This may be a silly question but in this case, would I need to take the ripped underwear back to store for investigation, or could I take the rest of the pack with the remaining 5 pairs that I haven't worn? For obvious reasons I wouldn't feel comfortable taking worn (even if it was just a couple of hours) underwear back, I would defo have to wash them first, but would that make it harder for me to be allowed an exchange, as they could then say it was my washing machine or other such excuse?

    Wash the pair you have worn and take all 5 pairs back along with your receipt. Point out the damage and ask for a refund, I'd be amazed if they refuse but if they do you can argue that they were not fit for the purpose and that overrides their no returns on underwear policy.

    Go on a saturday afternoon, they will be mostly saturday staff run off their feet who will just refund no questions asked lol

    not fit for purpose, your get a refund.
    I would not wash them. I doubt there look to closely at the product unless lots of complaints.

    The Primark return policy on underwear only means you can’t return them just because you’ve changed your mind, and personally I’m glad that stores have that policy on underwear, otherwise you could end up buying undies that someone else has tried on, and taken back, eww! However, as all stores usually state in their policy, they say this ‘does not affect your statutory rights’ and your statutory rights are that you are entitled to a refund on faulty goods, and underwear that falls apart after one wearing are faulty goods, not fit for their intended purpose because, unless they are sold as disposable, you would be well within your rights to expect them to be worn more than once, no matter how cheap they are. You would have to take the faulty pair back, to show that they are faulty, but there shouldn’t be a problem getting a refund, by law they have to refund on faulty goods, I’ve even taken things back to the pound shop if they’ve been faulty, lol!

    As you said, Primark isn’t known for high quality, but I’ve had many pairs of their cheap undies, and I’ve found that they last just as long as more expensive ones, and I would definitely take them back if I had any that fell apart that quick.

    I take it you didnt see the "reveal" thing about this exact issue? That places were taking back underwear customers returned (after having worn) and were putting them right back out for sale!

    They even did tests marking underwear, returning them and sure enough, some were back out for sale within minutes of the customers leaving.

    So word of advice, ALWAYS wash before wearing.

    Primark have a strange policy on underwear.

    I totally agree with them not accepting returns on knickers (but in this case they are faulty so Primark should replace them).

    But they allow returns on pairs of tights (still in the packet) but not on long-johns (still in the packet).
  • Well this is an intresting topic which I thought Id wade in on.
    1- If a customer has bought an item and had chance to view the item then the customer is only entitled to return that item if it is faulty by law.
    2 - Shops do not even have to offer a credit note or an exchange on any item that is sold in store, the only reason most do is as a good will policy.
    3 - With regards to underwear a store dosent have to accept any goods back (full stop) unless faulty, the reason they dont accept garments back that have direct contact with genitalia is the fact its unhygenic.
    4 - However you item is faulty, the elsatic failing within underwear is a manufactures fault and therfore you will be entitileld to a full refund, the only case that you wouldnt be is if you had had these for a couple or so months and this could be then deemed as reasonable wear and tear.
    5 - In this instance since you have only had them for a short while the store will not make a fuss about this and if they do your next step is trading standards who will take the case up for you.
    6 - Know your rights though as so many people are misinformed of them and once you buy something thats it, always check each individual store policy, as what next or m and s might offer isnt going to be the same as what another store offers.

  • I think the only retailer that allows the return of underwear is M & S. Someone I know works on the returns desk and she says she's had soiled items brought back (men's AND women's). GROSS !

    I got some primark socks - two packs (5 pairs a pack) and they smelt like mildew before they'd been worn. After wearing them, they smelt like nothing i've ever experienced... and no, it wasn't me :P.

    I would return them but I had to bin them and seal the bag to avoid the stench.

    Never again...I dunno what they make them out of but it's bizarre.

    Oh and my batman tshirt I got shrunk so it's only JUST too big for my 4 year old cousin.

    Ive seen folks slate primark before
    i only own a few T shirts from primark(so not a big sample) but they are the T shirts we wear for Krav Maga
    so they get a pasting. so far they are very good T shirts!
