Second hand xbox sold as new-Play.com seller

Just bought a "new " xbox elite for my son from one of the sellers on Play.com.

When it turned up yesterday we opened the box and it was obviously used.

We have e-mailed the seller and I will let you know the outcome:mad:

    You say "one of the sellers on Play.com" as opposed to just Play.com

    I assume you mean one of the Play Traders.
    These are just people selling their old junk they no longer need, like Ebay with a Buy it Now

    Yes people on play.com are traders thats just like ebay. Did it say brand new in the add?

    How much did you pay for it, what size hard drive does it have, and does it work?

    If it was a low price and works fine, then there's nothing to complain about, really.

    The same sort of thing happened to us but with a different company.At the height of the wii revolution when they were extremely difficult to get hold of we were lucky enough to manage to get one from Zavvi.When we got it home it was scratched and when we turned it on the date and time was correct and did not have to be set,it was second hand being sold as brand new.

    we took it back to Zavvi who apologised and explained that they did not have any new ones in,but they would be getting a delivery later that week,they asked us to keep hold of it and on friday they would exchange it for a brand new one.

    I went in on that Friday to see a lot of people waiting for this new delivery of the wii,when i got my chance i explained what had happened and they exchanged it strait away for a brand new one,there were three customers waiting in the queue who were almost begging the sales assistant to sell them the second hand one.

    Zavvi has now gone.....But luckily enough(fingers crossed) our wii still works.

    its used in what way, has it been opened as in the warranty sticker has been removed or do you mean its scratched etc

    It was listed as new.

    There was no booklets or instructions,the bags for the leads etc had been re-sellotaped up,the plug was scratched. No warranty sticker.

    I paid £110. It is a 120gb Elite. I know this is a good price for new but if it was used shouldn't the buyer be honest enough to say so?

    If I do send it back do I have to stand to the postage?

    I assumed it would include all the paperwork considering it was supposed to be new, I will be trying it to see if it works ok, will let you know
