Soooo fed up with ebay!!!!! Help

So basically everyone this is my first post cos I'm just pee-ed off now. I sold a dress about a month ago of about £70 roughly,I had bought it the week b4 off ebay for roughly the same price it was for a wedding however the wedding was cancelled (dont ask!) SO I sold it to a girl, but for some unknown reason apparently it was damaged, REALLY completely untrue as I inspected the dress fully and actually loved the dress but could'nt afford to keep it for no occassion. She opened up a claim and took photos of the 'damage' I said I wasn't interested in seeing them as I knew she must have caused the damage herself as I am a good ebayer if I say so myself. (any damage on anything however small I have stated in the listing)
SO I offered a partial refund then a full refund as she literally wore me down, I messaged another ebayer who the girl had left negative feedback too also who told me to get my dress back as she is 'mental' and will end up getting a refund and then keeping the dress as was the case with her.
SO I said I would refund, knowing full well she was obviouslly a scammer and knew that ebay do not respect their sellers which I have come to learn. A guy in paypal had clearly told me that as a seller on ebay I have no rights at all!!!! WTH?? I asked him to repeat this 3 times thinking I must have misheard!! :eek:
SO basically now and sorry to ramble, my paypal is minus the above amount I cant use it at all. I have waited over 2 weeks to recieve the dress that this girl apparently posted back, all I really want to do is get my dress back sell it again and be able to use paypal. Im actually really skint at the moment and can't afford to be out a dress and the cost of it!
Anyone any ideas how I can start using paypal again? Ive rang numerous times but apparently Ive to wait 45 days for her to post the dress :S Bizarre!! She provided a tracking number but I think that she's posted somethin else I dont trust her at all. Im happy to refund her when I get my item I just want to end this and when I do Im closing my paypal account the customer service is just TERRIBLE!!! UNBELIEVABLELY BAD!!
After my ramblings there what I would appreciate is advice on how can I end this once and for all. Ive contacted ebay and paypal and they have been so unhelpful:(

eventually the case will be closed either when the tracking shows as a)delivered or b)attempeted delivery
or c) the dress never shows as either of these and the case will run to a close 45days after she made payment to you and you will then win and get your pp funds released.0 -
If she posts something back tracked then unfortunately Paypal will no doubt take her side. They shouldn't refund though before you get it back.
A bit late now but as they tend to go with the buyer, you would have been better keeping the buyer onside, regardless of whether you believed her. Asked her to return it to you & said you would refund as soon as you received it back. Initially there was a chance that you would have received a saleable item back, unfortunately you will now get a damaged one.
If you have your cop still, then if the weight of the item she posts back is different so you have proof that she didn't send back the same thing, then maybe Paypal will go with you but probably not.
Closing your paypal acct, is probably a cut off your nose to spite your face act, as without you can't sell on ebay.0 -
Thanks for ur replies, I should have been 'nicer' to her but I just knew she was up2 no good. Should I just sit tight and wait for the dress and if it doesnt come then eventually I'll get my money back then?0

Yes, unfortunately that's all that you can do. Don't forget to block her from bidding on your items again & when she leaves you a neg, reply to it calmly, stating that you offered a full refund on return of the item, that way you sound like a reasonable seller.0

So sorry to hear of your story - I have recently had a very similar situation with a handbag I sold and a dishonest buyer who kept the bag and opened up a paypal claim stating it was damaged. I ended up £164 out of pocket AND she didn't return the bag. I have complained to the Financial Ombudsman, but they state you need to complain to paypal in writing first, which I did by their e-mail process, but they will not engage in any correspondence until the balance is clear.
Paypal didn't wait too long by the way before passing my negative balance on to a debt collecting agency WITHOUT making any proper effort to contact me first.
If you search the internet 'how to complain about paypal' you will see lots of horror stories like ours. It's very stressful indeed, but please do complain to the Financial Ombudsman if you have been treated unfairly by paypal or ebay. It's only if we all do this - and paypal don't make iteasy, that we can stop their bullying tactics.
Good luck - I hope you get your dress back. Unfortunately it seems to be a buyers world with very few rights or protection for honest sellers.

If paypal refund with no proof that you have the item back then you need to phone them. They are not always th ebrightest of people but as long as you know the rules and cna point them out to them they will reverse their decision.

Yes it's in Paypals user agreement. The only time the buyer shouldn't have to return is if the item is proven to be fake op if the transaction was problematic for some other reason. e.g you didn't reply to the dispute within the stated time (they then are within rights to issue a refund before return). Phone them again and keep onto them as Soolin says they sometimes need reminding,Soolin - is that true? If that is the case, you need (I am not sure of your timescale) to get back on the phone to Paypal and quote them their user agreement.

Seller protection starts at point 11. If the crux is the point you highlight (the item was never returned) then point them specificially to the buyer protection section 13.6 (if this applies to the buyer then the reverse is true of the seller IYSWIM). So ask Paypal what evidence the buyer gave to show the item was returned to you. Unless they can show it was refused/delivered or attempted, then you can battle your case easily.13.6 How is the Claim resolved?
Once a Dispute has been escalated to a Claim, PayPal will make a final decision in favour of the buyer or the seller. You may be asked to provide receipts, third party evaluations, police reports, or any other information or documents reasonably required by PayPal to investigate the Claim. PayPal retains full discretion to make a final decision in favour of the buyer or the seller based on any criteria PayPal deems appropriate. In the event that PayPal makes a final decision in favour of the buyer or seller, each party must comply with PayPal’s decision. PayPal may require the buyer to post an item back to the seller that the buyer claims is Significantly Not as Described (at the buyer’s expense), and PayPal may require a seller to accept the item back and refund the buyer the full purchase price plus original postage costs. If a seller refuses to accept the item, PayPal may award the Claim in favour of the buyer, provided the buyer has provided satisfactory evidence to PayPal that the item was sent to the seller. In the event a seller loses a Claim, the seller will not receive a refund on his or her PayPal or eBay fees associated with the transaction. If you lose a Significantly Not as Described Claim because the item you sold is counterfeit, you will be required to provide a full refund to the buyer and you will not receive the item back (it may be destroyed).0 -
