This is a bit of a long story, so bear with me!
As you can see from the title of my post, I'm in the right this time, and I don't owe anyone ANYTHING!!!!
On 4th February 2006 I paid £100 deposit on a Y plate Citroen Saxo from Carcraft. It took a couple of days to get all the finance in place, but on 6th February 2006 I drove away (after being missold an NAC warranty and two lots of PPI, although I didn't realise this until I got home).
I had to have two loans for the car, one from Black Horse and a top-up from All-In-One (now Creation).
The original credit agreements comprised the following;
Black Horse:
Car: £3,785.00
PPI: £823.80
Creation:
Car: £1,151.82
PPI & Warranty: £1,857.77

This was a over £7000 for a car that was supposed to be under £5000. As soon as I realised what I'd signed up for I called both Black Horse and Creation and cancelled the unwanted PPI and Warranty. I received an updated Credit Agreement from Creation and a confirmation letter from Black Horse.
On 2 April 2007 (14 months later) I settled the two outstanding amounts of £3219.13 for Black Horse and £938.90 for Creation.
So, to all intents and purposes, my dealings with Carfraft were over.
There were many misdeamenours from them along the way, but that's for another forum!

Imagine my surprise then today when I do my monthly check on my credit reports to find that Carcraft have put 2 accounts on my file, one for £248 and one for £1243, and have defaulted them for June July and August 2010, with no mention of these accounts previously! I have tried to speak to them today, and I am waiting for a call back from them. I have a horrible feeling that this isn't going to go away quietly.
What I don't get is how Carcraft can put anything on my credit file - I had no credit with them!
Please help! Where do I stand? I have been throught all my paper work with a fine-toothed comb, and can't see anything relating to these amounts at all. As far as I am concerned that accounts were settled. Where on earth have these defaults come from all this time after I first bought the car, and why have they come form Carcraft? I'm so cross! :mad:

Upadate: I posted this on another board yesterday, but noone could really advise. I have since posted a letter requesting CCAs and not acknowledging any debt etc.

    I've heard so many horror stories about them since I dealt with them in 2006! Unbelievable. What I think is terrible is that apparently they never use prime lenders for the finance, only sub-prime, so you'll always be screwed on the APR.
    Do you know when I was looking over the paperwork I found the piece of paper detailing the warranty I signed up for, and NOWHERE on it does it say how much it is, or even that you have to pay for it. It was only on the Creation credit agreement that this sum for a warranty actually appears.
    I'm glad I'm nowhere near as naive now as I was then.

    Don't want to go ot but yes, they are rubbish.

    They tried all the usual trciks on us, taking your keys, making you sit around their grim showroom, prices 3-4k higher than the Internet, oily greasy sales guy.........we couldn't get away quick enough.

  • Sorry I can't be much help but just wanted to agree with the sentiment that Carcraft are scum.

    Went in, found a car we wanted, had to hand over the keys to my own car (as a trade-in) but they wouldn't tell me how much they'd give me for it. Sat in a dingy cubicle for 3 hours while they tried all their confusion techniques, even though we'd realised within half an hour of being there that we didn't want to do business with them. I just wanted my car keys back and my £100 deposit.

    In the end they only gave me my money and property back when I went into their reception area and started shouting at the customers walking through the door to stay away or they'd get ripped off.

    Good luck with your dispute with these leeches.

    If you settled the credit agreements in full you will have a letter/email (defintely something in writing) from the funder informing you the accounts have been settled - do you have those confirmations?

    If you do not, you need to obtain them asap.

    I also refer to my previous reply; before CarCraft (or any organisation) could apply to list items against your credit report they would need to prove they've attempted to contact you - do you have those letters?

    If you've moved, they could be caught up in a postal redirect?

    I own businesses in the vehicle funding sectors and am FSA approved so I should be in a position to advise you in some capacity.

    Firstly, thank you for your replies!

    I have it in writing from Black Horse but not Creation about the settlement (I have a feeling this got lost in my last house move. Worse luck). I do still have my bank statement showing payment to the two companies though. I had thought that it was maybe in relation to the Creation amount. But the two accounts Carcraft have created on my credit file bear no relation to the finance I had with Creation.

    As for the post, I moved house 14 months ago and redirected my post for 3 months. I got nothing from them then. I'm fortunate that my brother has moved into my old place, so I'm still getting any stray post. Nothing from Carcraft.

    I may contact the two lenders directly. I contacted Consumer Direct at the weekend, and to cut a long story short, they are in essence equally responsible for what Carcraft do under section 75 of the Consumer Credit Act.

    It's ironic that about four days beofre all this kicked off I nearly shredded everything that was over three years old and cleared! How annoyed would I have been then, when I couldn't put my hands on ANYTHING! I'm quite relieved my other half stopped me!

    Sorry to hear about your Problem... I have one default on my record also and the other day Credit Expert informed me that you can email them Subject - Notice of Correction and explain why you have defaulted ie: Mistaken Credit agreement or unknown Crdit agreement etc and they will put it on your record therefore when credit agency search you they see why you have defaulted rather than just "didnt pay it"
    Dont know if thats any help just thought if they cant remove the default may be worth doing that to cover yourself.

    As for carcraft a tip to all - we went to look at cars (actually to check boot sizes etc we were never planning to buy from there too expensive lol just wanted to see sizes so we can bid on ebay lol) we took with us a perfect escape clause my son..........after a few minutes looking and being annoyed by a salesman my son did his usual im bored style whinging and then a big poo they couldnt wait to get us out of there :rotfl: so we left with our original car and a good idea of what to buy in the future - no purchase neccesary

    My thanks to Linzi, but I am waiting for a call back from her colleagues, and have been since Wednesday. I am disinclined to absolve them of any responsibility for returning my call or responding to my letter by calling Linzi and repeating myself!

    Hi Annibee, thanks for your reply. I did know about notices of correction, but I had heard that lenders can look upon them unfavourably, so I'd rather get the whole thing taken off.
    When I went to Carcraft I had my 6 month daughter with me - didn't put them off one bit.

    Something else I remembered today; the guy that sold me the car had the cheek to ask me out on a date!!!! You gotta love it.

    I do have another question though. I thought that only one default could be recorded against an account. Carcraft have recorded one for each month since June 2010 on two accounts, which means 6 defaults so far. Can they do this?
