Phones4u deny responsibility

I took out a HTC HD2 on Vodafone via Phones4u in Feb. Since then the phone has been with HTC for more than 10 weeks being repaired on 3 separate occasions. Eventually HTC replaced handset and now it is doing the same. I want to cancel the contract. However Vodafone says they are not responsible cos it was bought thru Phones4u, and Phones4u says it is Htc's problem.

    Correct, the only people who can canel this without cost to you are Phones4u.

    That said airtime and handset are twon seperate contract, you unlikely to get it cancelled but you can try.

    phones for you are responsible, they provided you with the contract. the phone was not fit for purpose, mention and look into the sales of goods act.

  • How do you think Phones 4U should cancel the contract? Vodafone are the ones providing the service, they send you the bills every month. Your best bet would be trying to get a different phone after all surely its the Phone thats the problem and not the minutes and texts? So why would you want the contract cancelled and not just a new phone?

    Phones4U are the people who got the commision, Vodafone will let them cancel without cost if there is a problem as the retailer but not the OP.

    I didn't say the SHOULD only they COULD, World of difference, even if P4U have the ability to cancel it the OP has to argue it with P4U as the retailer not Vodafone.

    It does soung like a phone issue and you have the legal right to have it repaired or replaced, however thats the retiler choice (p4U) not the OP. As it's beeing repaired there is no legal recourse to get a new phone although it must be irritating to the OP.
  • Yeah thats true, the OP does need to argue with the retailer and rightly so as the phone doesnt work but they are arguing for a new phone, why should they be able to walk away from the contract as the service provider has done nothing wrong. It would be great if we could all do that every time our phone went faulty!
    Everyone wants the best deal on the latest handsets but if P4U or Voda are cancelling contracts left right and centre it will only lead to increased charges for everyone else!

    Vodafone wont let P4U cancel the contract after 8 months either, the only way to do that would be for P4U to pay out the remainder of the contract to the OP who would then pay Vodafone.
