Help with orange/e2save problem please

Back in July i ordered a mobile from E2save on a 12 month contract,they sent me a 18 month one which i returned and they sent out the right one.
The problems came when orange started billing me for this returned phone there saying e2 hav'nt cancelled it e2 are saying they have.
Every time i phone they just put the blame on each other say they cant talk to each other because of data protection i have now had 4 bills and today i have had a letter from a collections agency saying they want immediate payment.
If any one can help me please :mad:

  • I would refer this to Trading Standards and Ofcom or Oftel or whatever they call themselves now. If Orange are the ones that have initiated the action against you I would send them a recorded letter telling them of the action you are taking and asking them to hold off and do the same with the collection agency.
    I would tell you more but I might be infringing their human rights and of course there is data protection to think of. The sooner we tell our MPs that enough is enough and we are fed up with organisations hiding under this political correctness the better. To do this though we have to say to them we aint gonna vote for you unless you do something.
    Also as I say now to as many as possible refer to the CPW website for their charter and what they have committed themselves to as far as customer relations go.

    I shall try calling them both again on monday and see what they have to say this time.Not sure what company is to blame though even tried calling cpw and they said it had gone through to orange .
    The letter i received even said a default has been registered against me with a credit reference agency so looks like i wont get another contract phone in the future

  • lyns all I can tell you is something that happened to me a few years ago when I had a debt collection agency threatening me. I rang them and told them I was in dispute with the company that claimed I owed them money. If you are polite but forceful and if they get stroppy tell them you will hold them responsible. Once you have disputed the claim and there is no judgement against you they should I believe not be able to issue you with a bad credit reference - I say should. They are usually just a first step to make you roll over. Collect all the facts you can and send them to all three parties and tell them you are holding them all responsible for any loss or injury.
    It should be clear that you have not enjoyed any benefits from this supposed contract. Have E2save acknowledged the return of the original phone? You do need as much in writing as possible. If you speak to them on the phone confirm everything they say in writing to them afterwards. It is not even three months yet so it is not even if they say you have not acted reasonably. Dont let yourself be bullied so seek help and dont try to do this on your own if they are not going to act reasonably.

    yes e2 have said they had the phone back and sent a note with the new phone saying they would disconect the 18 month one.But orange will not give me a address to send it to

    I have a contract with orange for the other phone and pay that by direct debit

    Just seen this on the orange site terms and conditions. "disputes between you and us

    19.10 You may request that disputes between you and us are referred to arbitration under our Code of Practice for Consumer Affairs. We will supply a copy of our Code of Practice for Consumer Affairs to you on request."
    Its probably worthwhile to read the t/c of both parties but Orange look a lot more professional.

    I phoned up both of these companys again today e2 told me to hold the line and then put me through to orange.
    orange then said theres nothing they can do to help and e2save had took there commision for the phone.
    I then phoned traiding standards who took all the details and said to write a letter to all involved the lady also said i would have to get in touch with experian as i am more than likely black listed and not to apply for anything on credit untill its all sorted .I am now trying to sort out a letter that sounds good and find out who and where to send it to at e2save.
    I just hope i can get it all sorted before my babys born

    Ah CPW at its best yet again.. seen this happen a few times whats happened is e2save has not contacted orange with a RA code in time to term the contract. then orange has paid e2save there money.. once u phoned e2save they thought whopps we forgot to do that. pass buck..

    e2save normaly ammits they are wrong at the end and get you to get the amount to buyout the orange contract which e2save will pay u.

    what should of happened IS as soon as they got the handset back e2save should of contacted channel returns got a RA issued and got account term. You should not need to contact orange as its up to e2save to stop the contract within the time they have

    Sent my letters of to all involved and got a email just from e2save

    Once I have received the letter you have been sent I will raise a cheque and
    this will be sent to your home address to enable you to pay orange.

    My question is if i do this will orange think it was me in the wrong and should i get E2 to pay them direct
