    I'm interested in the mcdonalds scenario: wouldn't a 'loss of custom' be difficult to prove without clear evidence that the park was full on the date and time the pcn was issued?
    That's always been the argument on here. It's the same with a supermarket. If all the spaces are full, and a supposed customer cannot park, how do you prove how much money they would have spent? Would it be 40p for a bar of chocolate, or £400 for a case of vintage Champagne? This is one difficulty a PPC would face if they were ever stupid enough to use this in court..

    Don't forget the recent(ish) case where the victim paid, found out that it was an unenforcible invoice, sued and got the money back.



    It was this case against Parking Eye (Tazneem Patel and her brother).

    There was also reportedly a second example that I know of, where a motorist took a PPC to Court and won:

    Susan Pratt case (she paid a fake PCN then claimed it back in Court)

    No doubt there have been others that have never been publicised, or cases settled out of Court so a PPC can keep their scam quiet.
