Thanks - I have read the insolvency website so much that I can't see what it says anymore! I think the t.v might be a problem as its 37" and not even paid for. Buy now pay later - what a great thing that is. Never again I tell you!
Sandra - I seem to remember you having problems with having to justify the cost of your cats. Has the world gone mad? I was wondering what the outcome of that was? I keep rats, a thing that most people don't understand, but they are my babies and I couldn't live without them! How do you go about justifying rats to an OR?
Can I take into account on my soa the fact that my partners 13 year old eating-machine daughter stays 2 or 3 nights a week? She's not mine, but we pay for everything 50-50 (yes - he has to contribute to the rat posse's upkeep too!). She grows out of shoes and clothes before you get them home from the shop, what are you allowed to put down for clothing expenditure? Someone told me £20 a month?[/QUOTE]

It was Doushka who had the problem with the OR over her cats - we haven't heard from her since then so we don't know what has happened. Probably better to include the cost of your "family" within the housekeeping. If you are claiming for one person per month you need to allow £250. When I was working and with three cats, it cost me £60-£70 per week for food and litter - got it all in one go from Tesco.

Yes of course you must claim for your extra guest when it is on a very regular basis. How much have you got for your food, etc?

Do post your expenditure then we can see what you have missed out.

Clothing/shoes you claim as £40 per person per month.

Would like to join the club - hubby & I are in court on Feb 16th 07 for our hearing.

Can't wait as can't pay due to lack of work, brought on by depression, seriously worsened by the lack of money (feel like a hamster on their wheels!) :rotfl:

    Can I get a number?

Again, I must stress please dont just put down figures that people tell you!

Firstly, the amounts and items that you list in you SOA should be the actual amounts you are receiving and paying out. Please remember that when the OR looks into your financial affairs he can see if what you are claiming is correct.

If you add items of expense that you dont have or are more than you are actually spending you may well get caught out.

However, what you must try and do is set your outgoings to a reasonable amount to enable you to live on before you go bankrupt.

There is no point in setting an expense at a figure which is less that what you are actually spending, if you do, you may well find you are overspending after BR and run the risk of ending up where you started off with debt.

  • Ok done it! can't stop crying now! (blinking baby i am)

can someone do me a favour and just check this 2 things seem ok before I print the forms

    my reasons for BR:
The thing that causes me not to have enough money is in part to my overdependance on alcohol and this means household budget is spent, then food petrol etc is put on credit cards which then lead to paying credit with cards / overdrafts in a vicious circle. Any emergencies also put on credit cards, also recently I have been off work on a few occassions with a bad back and extra expenditure for emergency Oestopath sessions have caused further problems and brought to a head the situation I am in.

    and statement of affairs
    Rent £312
    Housekeeping £313
    Gas/Elec £ 77
    Water £ 33
    Telephone £ 32
    petrol £ 65
    clothing £ 20
    council tax £101
    essentials £95 (tv licence £12,optician £10,car tax/insurance,house ins)

    total £1048

    Income
    wages £953
    tax credit £ 95

    total £1048

should I put the money we owe tax credit on the form to? I know we still have to pay them back what ever (even if us and they don't know where we owe it from? about £3000)

If some one could look for me asap then i can get the forms printed
    thanks

Most people spend at least £75 per week on food when they live alone.
That is if they have a proper diet. Some of the weekly food plans on here for £45 per month for four people will have them in the hospital within a year!!

The OR's are not daft - they live in the real world - they know how expensive things are.

At the end of the day most folks are not in debt due to their ordinary living expenses like food, it is because of excess credit.

Don't print the forms out until the day before your bankruptcy.

Your housekeeping should be £400 per month

    Your clothing/shoes should be £40

By the way, are you still anticipating having to pay for an osteopath? If you are, you need to allow for this in your SoA. You cannot get this treatment on the NHS, as far as I know.

The point I'm making is the figures that you quote are the ones that you swear on oath at court are true!

By putting down a figure that someone recommends you should put could land them in alot of bother, and even result in a BRU/O!

People coming here are seeking help, not looking for things to compound or even worsen their problems!

  • Whilst this is true, Less, no-one is trying to mislead anybody or to get them into trouble. We haven't done that nor will we.

The advice given by people here is down to their own experience with bankruptcy or through their own work.

The figures most of us use are the CAB advised guidelines.

I am with the CAB, by the way.
