    I am having this problem lloyds tsb are ringing at least 5 times a day each time i tell then my bankruptcy details and that i told the last person the same thing and that this constant calling was harassment and if they carried on i would be reporting them so they stopped the calls for a total of 2 weeks and now they have started again.

    I had it with HSBC, and Metropolitan Collection on their behalf - eventually I complained to their customer services manager nd got a very pleasant personal letter from him, promising me that I would not hear from either them, or Metropolitan again. Two days later I received a letter from Metropolitan, threatening legal action. :mad: :mad:
    I complained again, this time copying the letter to the CEO of HSBC - I have had no further communication from either HSBC or Metropolitan.
    I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
    If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

    At the end of the day you are supposed to be allowed to live a near normal life and those items were allowed.

    could be that your OR was being difficult. I don't know.

    TMD - you are not claiming enough if this is for two people!

    Have copied your SoA -

    Our SoA is currently:

    Income

    Total £2000 after tax


    Expenditure

    Rent £725
    Council Tax £159
    Groceries £200 up this to £400
    Water £34
    Electricity £140 (fixed monthly DD, everything is electric)
    TV License £12
    Telephone (Line Rental & Bills) £15
    Clothing £20 Up this to £60
    House Insurance £28
    Petrol/Public Transport £200 (I currently commute 60 miles a day, hence the high fuel costs)
    Tyres £25
    Servicing £15
    Insurance £75
    Road Tax £10

    Total £1643

    Also I think the OR is still allowing for Christmas/Birthdays/Holidays - so add £50 per month for that too

    Firstly, the amounts and items that you list in you SOA should be the actual amounts you are receiving and paying out. Please remember that when the OR looks into your financial affairs he can see if what you are claiming is correct.

    If you add items of expense that you dont have you may well get caught out.

    However, what you must try and do is set your outgoings to a reasonable amount to enable you to live on before you go bankrupt.

    There is no point in setting an expense at a figure which is less that what you are actually spending, if you do, you may well find you are overspending after BR and run the risk of ending up where you started off with debt.

    The Official Receivers have tables of permitted amounts for expenditure, and as such will guide you should any of the amounts appear excessive.

    With regard to Christmas, Birthdays and holidays, it varies from OR to OR as to whether they accept them in you expenses. All you can do is include them and hope for the best.

    Other items which you may wish to include if you have them are Gas, dentists,haircuts,vets,mobile phone and internet (If you can justify it!), dentists and opticians.

    You have included an amount for tyres of £25 p/m which seems a bit high. I would suggest that you include an amount for car maintainence which would include servicing, tyres and general maintainence.

  • I agree wholeheartedly Less.

    The point with TMD was that he was only claiming on his SoA for one person when he should have been claiming for two.

    The problem with clothing/shoes is to allow a modest amount to cover themselves.

    Regarding Christmas/Birthdays/Holidays - I can understand an OR being iffy about holidays. Not in this case, but if a couple have children then Chriistmas and birthdays become really important to the family as a whole and should be allowed.
    At the end of the day, rightly or wrongly, it is the OR's trying to achieve every last penny to increase the IPA!!

    Surely each OR should follow the same rules so if one OR allows things they all should. And it should not matter if it is an individual or a family. Christmas, birthdays and holidays still exist for single people

    There REALLY is no justification in the variation between ORs. We have seen this all too often, on this thread. To say that you are not 'allowed' to celebrate Christmas, or take a holiday, is surely something that shouldn't be dependent on the whim of one person.
