Good luck with your daughters first day at school, we have four grown up children and their first day at school always seemed to be a conflict of emotions.
Many thanks for your reply; it has made sense and I think we may have omitted to supply the O.R with a copy of the lease. It was the property company who were responsible for our bankruptcy and I assumed that they would have been in contact with the O.R and furnished any necessary documentation; I obviously need to do some more work on this.
I didn't realise that you worked as an O.R and I really do appreciate you taking the time to respond to my post. Our file has been moved from the original office to another one because our house was involved and I don't think the new office has got on top of things yet.
On top of all the other bad news we had around Christmas and an absolutely awful year I think I've let things get out of perspective.
Once again, thank you very much,
Richard
Hi Richard
The OR may well have had the lease from the property company - they wil certainly have asked for it! I guess your file has gone to RTLU (don't ask me what it stands for) to deal with the property. If that is so they don't usually deal with admin matters (such as lease disclaimers), they simply deal with the assets. If the lease had been disclaimed then you should have been sent notification.
Even if your file is at RTLU, the details for your case can be brought up by any OR's office, so your original office should be able to tell if the lease has been dealt with. Alternatively (if you want) - PM me your full name (as it appears on your BO) and your case reference details XXXX county court ??? of 2006 and I can look for you tomorrow (don't do this on the forum as it is personal information). I will be limited to what is recorded on the computer system and the quality of this varies from office to office.
My biggest advice is don't worry! If you are really concerned there should be a "CCLU" (closed case liason unit I think) member of staff in your original office who deals with queries on "older" cases.

On another forum a friend of mine had bought a computer costing £1000 with her cc, 14 months prior to her bankruptcy. The OR took the computer and offered for her father to buy it from him for £300. Her Father offered £200 which was refused. It went to auction, her Father attended the auction and the laptop was sold for just £100.
These stories I have posted are true stories from people whom have gone bankrupt in the last 12 months.
Yes it would cost them a lot more than the value of the goods!
Whilst the OR has guidelines, I think that power sometimes goes to their heads!0 -

I dont believe I have anything of excessive value, I bought an LCD TV about 6 months ago for 399, but thats probably the most expensive thing I own. I also have a guitar I bought about 18 months ago for about £400. I cant see the value of any of these things being much. I really cant think of anything else. Hopefully they wont take any of my personal posessions. It means alot that there is such a knowledgeable person around here. Thanks.
You have got to remember that, whilst there are guidelines, the OR's have a mind of their own.
The stories I posted are TRUE, they are not made up!
Like the premium bond that was seized that was worth £1. Rog2 can vouch for that when he is back. They took his. They took £5 of premium bonds from a friend of mine.
It is quite common for both desktop and laptop computers to be taken - that is FACT - even computers that have been five years old! No, they aren't worth anything but the OR can and did take them for sale at auction!
Don't underestimate the powers of the OR.0 -

I dont underestimate their power, but I did expect them to be resonable.
Lets hope I get one with an ounce of respect.
For me, its humiliation if they start taking your 3 year old computer etc. You need to retain some aspect of life afterwards. I would rather them take more of my disposable income then take things which give you some standard of living. I dont think keeping a guitar and an old PC is living like a king. I know its my fault I am in this situation, and I do want to pay back what I can.0 -

Thanks for your responses Missimaxo, I think we have now decided to wait until we have moved into rented property before declaring bankruptcy (although we haven't yet decided whether it will be both of us or just me).
We decided to move last year so that we can be closer to OH work, we can then get rid of one car (or both cars if I stop working) and save £££. Our biggest concern is being homeless so hopefully we can hold out on the BR until after the move.0 -

Hi this is my story
http://forums.moneysavingexpert.com/showthread.html?t=339705
If my husband goes bankrupt as all the debts are in his name not mine what things would they take from me? (Such as childs laptop?)
Also we have a holiday with my in-laws booked in my name to be taken in September. (Booked in september before we realised how bad the situation had got) Will our holiday be effected as I paid some of it (about £1800) with hubbies credit card.
Also after he has been bankrupt do they closely monitor everthing we spend and if so for how long?
Any help would be greatly appreciated. Many people have given good advice which is greatly appreciated but a couple seem to take the approach that we they have cut back on everything (even tv apparently) therefore so should we. They didn't actually say that they were better than me as they are paying their debts as opposed to going bankrupt but thats the feeling which I got from a couple of people (maybe I was mistaken and took it the wrong way). This is all very daunting!
