    if my friend was desperate to stay until they found somewhere i think i'd let them be my house guest for probably a month or so. Surely this is ok??? definitely if t was a family member. if they slept on the sofa and lived out of a suitcase, i think this must be ok,surely?????!!! assuming they didn't pay rent and it was just a favour in their hour of need?

    i understand the HMO rules make a bit of a difference, but surely you can have guests????

    we are not arguing that you cannot have a guest... we are arguing tht OP refuses to listen to a wide range of MSE wise posters saying the same thing over and over and over....

    trouble about guests is - i have never come across a definition of when a "guest" becomes a "squatter" and i suspect the legal definition is crucial to any landlord trying to get them out..
  • cheers for all the advice, im not being arrogant im just exploring all of my options. Iv spoken with the LL and its fine that I stay for a few months untill I find somewhere. so all of the 'aggie' ones on here can chill! cheers to everyone who understands that i was obviously worried about my situation! it will all be sorted soon fingers crossed

    He's not kipping on the sofa/living out of a suitcase though, he's in a furnished room with a wardrobe (his words), using the facilities in exactly the same way as the other 4 rent paying tenants.

    Guests is a misnomer ~ how long does a guest stay before he ceases to be a guest?
    I ave a dodgy H, so sometimes I will sound dead common, on occasion dead stupid and rarely, pig ignorant. Sometimes I may be these things, but I will always blame it on my dodgy H.

    Sorry, I'm a bit of a grumble weed today, no offence intended ... well it might be, but I'll be sorry.

    Council tax needs to be sorted then . Plus if you are claiming any other benefits they need to be moved to your new abose. On that subject if you have brough a tv with you and your door is locable , guest or no guest buy a licence of your own.
    ONE HOUSE , DS+ DD Missymoo Living a day at a time and getting through this mess you have created.

  • I think the Council Tax thing depends on what the LL has agreed to - if he has just said that he has no objection to OP staying as a guest of his tenants for a few months, then registering for Council Tax will make it their main residence and could make LL liable for Council Tax if it is then classed as HMO... A little unfair if LL has agreed to them staying rent free as a guest while they sort themselves out.

    I would suggest that the actual tenants approach the council and notify them that they have a guest staying with them for the short-medium term and ask for guidance about when a guest stops being a guest.

    Obviously if LL is collecting rent from OP then that's a bit different.
