  • Thanks Pepzofio, I think you understand what I mean!

    I know that would be the right thing to do and thats what I want to do, but then there is the uncertainty about HMO and the liscense restrictions, meaning that the LL could just turn around and say 'no I can't let you as im only insured for 4 people' or something. So I cant really risk just asking him as he could just say no, so is there anyway that I can find out what HMO restrictions there are if any? It just seems silly as there are 5 furnished rooms!

  • The LL probably doesn't deal with the council tax, as each student has to prove they are exempt to the council and it's normally still in their names. You could easily register with the council and pay the bill and I doubt any correspondence would goto the LL.

    If you are just living out of a suitcase, not paying rent, and the bills and other posesssions are at your parents, I would class you as a guest myself. It's not your sole residence - you could move back in with your parents right? :)

    Obviously this only works short term, why cant you find a place to rent? Costs or just not much turning up?
  • yea I could move in with my parents althought Its not feesible as I work 90 miles away from them, I am in a way living out of a suitcase but obviously have a computer and clothes in wardrobes etc.

    I just need to know if the LL can let the 5th room out as then i can call him and ask about renting, but I can't call and ask before I know about the HMO and if it restricts the house to operate with 4 not 5 bedrooms as in a previous post he may just say no you cant and then im screwed!

    Cant rent as there is literally nothing to rent and the ones found are rediculously expensive
  • forgot to add how can I fid out how many rooms the LL can let without actually asking him!?
  • 5th occupant starts to make it a licensed HMO which is why he hasn't let it out already I think.

    Where are you looking for rentals? What is your price range/area? Have you tried rightmove.co.uk, gumtree, local newspaper classifieds?

    As a LL myself, please stop wasting your time on here - listen to what EVERYone is telling you - and go and find somewhere else to live.... Living as you are - you will not be insured and you may well invalidate the landlord's insurance policy should anything go wrong.. do you want to be responsible for them being injured and not compensated ?

    you are being very selfish - please go and look for a house share elsewhere.... dont be a wimp

    If this is the case, and living with your friends is a temporary solution, what do you envisage a permanant solution as being?? Also, you seem to be of the impression that if you manage to find out that the landlord can in fact legally let the room to you, then he will.

    If I were the landlord and I found out that my tenants had allowed someone to live with them undeclared and not making any contribution then the whole lot of you would be out on your ear, regardless of whether you showed me I could legally rent you a room!

    What were you doing before you moved in with them? How did you find yourself accepting a job in an area that you cannot afford to live in?

    I would suggest that you either find yourself a room to rent in a house legitimately OR look for a job closer to your parents and move back in with them until you can afford your own place OR Look for a better paid job/supplement your income so you can afford to rent somewhere in the area you want to live.

    I think you are putting your friends in an awkward position personally.

    I know this is probably not what you want to hear, but that is my opinion, take it or leave it.

I dont think you understand that im claiming to be a guest/lodger at the premise not that its my primary abode. so technically im not a tennant just a guest so nothing to do with the LL insurance.
  • How much does it cost to get an HMO license? and is it alot of hassle for the LL?

    Gosh, what a mature and well thought out response! ;) Perhaps Clutton and I have touched a nerve, as you are clearly in a pickle.

    I do actually sympathise with your situation, but think you need to face facts and look for a proper, permanant solution rather than pinning your hopes on a false claim that the room is not your permanant residence, when quite clearly it is, OR that you can convince the landlord to rent the room to you, which I think is doubtful under the circumstances.

    When you post on a forum you will get replies that are not what you want to hear - this is the real world and not everything is going to be sugar coated and wrapped up in nice.

    I have offered my advice and will lose no sleep about whether you take it or not.

    I will now happily "jog on" as you so eloquently put it :cool:
