    Is this not ebay/paypals problem?

    Was this an ebay sale?

Have you emptied your paypal account?

    1) I thought so, since I initially won

    2) Yes, eBay & PayPal

    3) Yes, I have

    What is going on?

Call paypal and remind them once again of your seller protection.

You must be as persistent with paypal as the bank is.

At least a fraudulent use of card claim is easily defended. I only ever had one, obviously I won it but i made the buyers life a bit difficult as well as I knew exactly what he was doing as he was actually daft enough to let me know in an email.

I think sometimes buyers think we are all daft, he was probably told by a mate of a friend down the pub that if you said you didn't buy it you just got your money back, forgetting that this is actually fraud and quite a serious offence.

What did they say in the email, and more importantly, how did you make his life difficult? Lol

Incidentally, I won this case even before the rules changed, and was not in fact covered against a claim for fraudulent use of a card.

The brief version was it was a US buyer who did a chargeback for fraudulent use of a card. I sent an email stating that I had received this claim via paypal and was surprised and I asked whether they were aware this claim was being done in their name.

The reply came back saying yes they were aware and they had the item but their grown up son kept logging into his fathers paypal account and using it to pay for ebay things so to teach him a lesson they had started to claim back the money.

I really am almost too embarrassed to say how far I went with this, however, the man who responded used a work email address, I checked the address out (it was a firm of lawyers) and I found his name on the list of vice presidents. The name was unusual so I also managed to track down his wife at her work (the Americans post all sorts of stuff online), I even found the local sherrif department. I sent emails to both employers keeping very strictly within the law but asking if my email could be passed on totheir employee as they were not responding via paypal , I also made a formal complaint to the sherrif. I had a personal response back from the sherrif who asked me to tell him off the record what had happened as he was aware of the family, and he would drive on by and give them a call . A senior partner at the firm of solicitors also asked me for info, I told him I could not say much as I did not wish to get anyone in trouble but I gave the facts, and only the facts that I could prove. He assured me that it would be dealt with and I would not suffer financial loss.

I had the claim dropped within 12 hours and a couple of rather nasty emails from buyer saying how I had embarrassed his family and all over a £30 item and he hoped i could live with it. I assured him I could.

  • Sorry I missed your reply soolin, that was brilliant!!!

Out of curiosity, how did they thinking getting their son something for free would teach him a (positive) lesson?

Even now I think back on that and wonder the same thing myself. We were not incidentally talking about a young person, but a man in his 20s. I also thought it strange that a lawyer would admit in writing that he was making a claim for fraudulent use of a card when the item paid for had been received safely, or maybe email doesn't really count at all?

Usually I am very easy going, but that incident was so blatant and the buyer had such a very unusual name I thought it worth making an effort.
