    If this is the case, then neither can make the claim. SFE will need to establish who the child is mainly dependent on, and that will boil down to who gets the child benefit.

    I'm still firmly holding up a "No" sign for this.

    For What? the Childcare grant through SFE? Only the father is at uni and would be the only one claiming that.

    ATM he is receiving PLA as he was receiving CB at the time of application.

    But the child is dependent on the Father, he has his child 50% of the time, having to provide, food, clothes, nappies, wipes, toiletries, warmth, etc. The mother is receiving tax credits but not CB. As for the PLA he has already been awarded it for 2009/2010 and has been approved for 2010/2011.

    It goes on who the child is mainly financially dependent on, and if the mother is claiming CTC, then I have to say it's not the student who the child is dependent on. I would not be prepared to agree paying PLA or Childcare to the student in this case.

    if the mother is claiming CTC THE FATHER HAD NO CHOICE

    Dont take it the wrong way, I feel for both mothers and fathers in cases like this, but I dont agree with people, organizations etc siding with the mothers. The mother broke the relationship with the father, through no fault of his own. The father has taken 50% responsibility for his child (sometimes more), he is trying to better his education, therefore bettering himself in the hope of a higher income and a better future for his child. Whereas the mother, works a couple of nights, has family and friends to look after her child (even when shes not in work) and tells the father its his turn to have his child , its his problem to sort out childcare, while she goes off to enjoy herself.

    I feel CB shouldnt be classed as the ONE receiving is the ONE responsible.

    I'm not siding with anyone, I'm just putting it bluntly to you from the viewpoint of someone who actually deals with the assessment of PLA and Childcare. There's no way in hell I would award it based on thsi, and I'm more lenient than SFE will ever be.

    But then again, you wouldnt award PLA and they have.
    Can I just ask then, if he cant get childcare grant, how is he supposed to continue at uni with his child? Maybe he could take his child with him? Otherwise quit. He has no way on earth to be able to continue with uni without childcare help. The mother of his child isnt working 9-5 mon fri when he actually is in uni, but wont have her child because it is his turn.

    They've awarded PLA incorrectly then in accordance with Regulation 42(d), and the award should be terminated. He should not receive either grant, without first demonstrating that the child is wholly or mainly financially dependent on him, which as you've openly said, the child isn't as it's split 50/50.

    Taiko, OK, so he hands back the PLA he has already received, tells them he is no longer entitled to PLA. Now this leaves him in the following situation. He lives off his maintenance loans & grants, supporting himself and his child, attends uni mon - fri, 9am - 5pm, and has no childcare option available, what is he meant to do? Surely the only option available isn't to quit? If he quits, then he will have to repay his DSA also. Surely there is something available for people in this situation.
